Working at Bank of New York Mellon

  • unknown 3 months ago
I was recently hired at BNY Mellon and right before my start date I received a call that they uncovered 2 hits on my rap sheet. Both of these hits only showed the arrests and they requested I submit documents of the ending dispositions. The ending dispositions were Driving While Ability Impaired by Alcohol (DWAI) and Disorderly Conduct. I know these don't prohibit me from working at a company insured by the FDIC, but I wonder whether or not they will try to terminate me because I did not disclose them on my job application. The question pertaining to prior convictions is worded as such: "Have you ever been convicted of or plead guilty to any crime? For purposes of this question, 'crime' means any felony, misdemeanor, offense or violation including DWI (driving while intoxicated), DUI (driving under the influence), etc." This is where I'm confused because both DWAI and Disorderly Conduct are not classified as a crime under New York State law, which is where they occurred. BUT the question mentions violations, which they both are. I consulted with a lawyer that advised me that these charges are the equivalent of a speeding ticket, therefore I did not disclose them. BNY Mellon asked about "crimes" but includes violations, does that mean speeding tickets need to be disclosed, because they are considered violations too. I am very confused and worried they will terminate my employment and say I lied on the application. Any insights would be greatly appreciated.
