    If anyone has had an appeal hearing (phone), how long after the hearing did you recieve your decision in the mail?

    I was laid off from my job a few months ago. The day of the incident, my employer said that he was letting me go because he did not have enough work available, and that my position was being eliminated companywide. I asked the employer if I was eligible to collect unemployment benefits, to which they responded "yes." Well, I just received a notice in the mail saying that my former employer has filed an appeal, stating that I was not laid off, but, in fact, fired for 'poor performance.' It seems to me that my former employer is trying to save a couple bucks. So, now I have to participate in a telephone appeals hearing with this slimeball. Of course, I'm extremely angry ,but I wanted to get your thoughts on this situation. Have you faced a similar situation? What was the outcome? Any advice is appreciated. Thanks.

    I was wondering has anyone interviewed for a position with DOL and did it consist of a written test and a typing test? If so what did it consist of?

    I was terminate from my job,but I was able to collect benefits, i explained the case to the adjudicary and he understand that was for medical reason, now my previous employer is protesting i will have a hearring in 3 weeks, if I lose can I appeal again and how about if i win can my prev. employer appeal again too

    My school district has appealed my unemployment because I took a job as a substitute teacher after being laid off as a parapro. I was laid off as a parapro in June 09. I already worked a part-time job which offered work during school weeks, but not outside of those weeks. I filed for unemployment, and was deemed eligible due to no work available as a parapro. During weeks when substitute jobs were available, I could earn more money than unemployment, while still looking for some other full-time employment (especially within the school system). I consequently did not file during those weeks, suspending my file. During those weeks when no substitute jobs were available, or where school was out, I applied to have my unemployment from the parapro position reinstated. While the DOL has ruled to reinstate unemployment benefits several times, the most recent has been appealed by the school district. Does taking a temporary position without benefits, with the same employer that laid you off in the first place, invalidate the original claim? No one who can do anything about this at the school district will give me the details of why they are appealing, because it is now a legal matter (even if it was a mistake on their part - I am concluding this is not the case). DOL won't give me any details other than the legalese booklet. Any advice? Any other teachers / parapros run into this?

    Please anyone help. I was laid off/fired from a job with a law firm in May of 2007. The firm split and I went with one part. First day with split off firm (I was still working in the same office for the same people) My hours were cut in half and I filed for unemployment and then I was fired. I was awarded unemployment but it went against the first firm because I did not have a enough hours with the 2nd. I had to sign a resignation with the 1st firm on 4/23 that they prepared. The other happen on May 1st. They said I voluntarily resigned - not true - I did not have a choice. The first firm lost/closed 10 offices down to 2. I no longer had a job with the 1st one. I was awarded unemployment. It has been appealed and went in my favor each time. NOw the law firm has filed in Superior COurt for judicial review. I need help I cannot find an attorney who handles this kind of thing. I spoke with an attorney for the dol. He says 99 % of people do not have atty. He said they do not attend. they forward the transcript from the hearing and all the decisions. DOes anyone know someone who could help me? Does anyone know how the hearing works, etc.? I am anxious for information. My benefits ended in October. This has been one of the most stressful things. It was bad enough being out of work, but then to be hounded by a law firm. A sheriff came to my house on a rainy sunday morning to deliver the summons. If I lose I have to pay back money I do not have. At the hearing with the dol, conducted over the phone, the attorney was pretty fierce. To say that I am scared, very true. BUt this whole thing is very wrong. These people did me dirty and now they are dragging this thing out just because they can. Thank you

    If someone can help plz contact me immediatly. I am appealing to Superior Court because DOL denied my unemploymemt to re-instated. My benefits was allowed in Oct 12, 2008. Then I received check until Jan 7. My employer appealed after 15 days and then denied my unemploymemt due to fact they said it was fault that I was let go. My separation notice said I was let go because of Falsafication of Timeclock. But now their saying it was my attendance and failure to follow orders. I can't afford a lawyer and no one will help me. I've prepared a case but I don't think its strong enough.

    Can you believe that a company well known as Caterpillar would treat workers UNFAIR? Well, believe it! I am here to inform you, unless you want to remain a temporary employee for up 2 years, it's best that you don't waste your time applying.There are temporary employees working at Caterpillar that have been told numerous times that they would be hired, and HAVE NOT, and if you ask to many times about being hired, your job will end the next day! So my advice to you,and don't say I didn't warn you,"If you're looking for FULL-TIME work,or equal opportunity, please go in the opposite direction of Caterpillar.

    This goes along with the appeals topic below. But I didn't want to hijack a thread in order to ask about my case. I have been receiving unemployment benefits since the beginning of July. My employer has appealed the decision. They say that I was fired because of unsatisfactory performance. I have received the evidence that they are going to present in the case and it is the write ups that I got while I was employed. I understand the burden of proof is on them. And that is why they are presenting the write ups. But no two write ups are for the same thing. And the final reason that I was let go is because there was a task that was assigned to 2 people before me and they didn't get it done. And one person after me and they didn't get it done, but I was the only one to get fired. My position is that once the next person assumed responsibility for the task...I was done with it. I was not even actually assigned to it. My boss just said that since it was there I should have done it. But by the time I discovered that it wasn't done, it was time for me to clock out for the day. I even told the next manager that I would stay and complete it, but he said not to worry about it and he would get it done before close. Shouldn't the responsibility fall to the last person assigned to complete it? Am I missing something? Why do they think they have a case?

    I won My appeal over ten days ago, i was never told when I will start to recieve Benefits in the mail. Its been ten weeks already and not one payment!!!! Does anyone know how long this will take? Thank You, Denise
