Well then I guess it is official. They always put them in the Notes before they disappear. Guess this means she is soon out. I mean after all they just made the stupidest move that left her exposed and at the top of the line to take the fall. Oh but like a game of dominos when one falls others follow. Did anyone her know that there is Tort law out there that says any supervisor of a company can be sued seperate from their company in a personal liability suit for making damageing statements which may cause financial harm to an employee in their control??? This puts all their personal assests and future earnings at stake. Love CNG Thanks.

Thank you soooo much for that info, it definately is most helpfull as I was not aware of that. Being that I have printed off and forwarded statements from "Marvin" and now -aka- "Happy Feet", a personal "torte", seems quite enthrawling and interesting to say the least. BTW> Thank you to "Scapegoat" for bringing what is real and truthfull to light!!

I do not know of any state that does not make new hires sign a non-compete.

The non-compete agreement is placed in each and every new hire packet for all employees in all states.

That is true but I thought that was one of the state specific forms not the big book with the I-9's, W-4, sexual harrassment, open door policy, handbook acknowlegement etc.(at least in IN and IL packages I have seen) I thought I read somewhere there was 2 states that CNG operated in (or used to they may have been run out of those states) that it was not part of the HR DOCS.

Hey all: The Senate in Ohio just PASSED HB545.......This puts a cap on "interest" at 28%(no fees), permits four loans per year and a lower cap of $500 down from $800. There are other factors in this HB545 also, but they're ALL GREAT!!! NO MORE "CHA-CHING" in Ohio. I will be there when Gov.Strickland signs the bill!!!! Sure made my day today!!!!!!!

i hear that check n go is the only check cashing business in the state of ohio still ofering loans. only to existing customers. But every other company has ceased giving loans. Leave it to check n go to squeeze every last dime from their customers

You have been with the company for how long if you haven't been there over a year then just buckle up and enjoy the ride your turn is coming. Did you ever wonder about the turnover in a company that had shut down in at least two states why weren't those people moved? You have no clue what you are talking about see the tenure of the people involved and when you get a clue let us know.

Best to get out now while you still can. They will set you up for failure, then put the blame directly on you. Creating a "hostile work environment" so you can't function properly. ith them using "Hunter Consulting" for their unemployment issues (they are under investigation also) your chances of collecting unemp. are 50/50. Don't give them the 2 week notice; they wouldn't give you one if it were reversed and if you do, they will terminate you for "the betterment of the company."

Employment law is getting personal.

An increasing number of executives, managers and other company leaders are being sued personally for their work-related decisions.

Labor and employment attorneys note that the increase in personal lawsuits has put upper management on edge, many fearing that every time they make a decision involving salary, leaves of absence or benefit issues, they could be sued.

Recent court decisions have added to this fear.

In June, the 1st U.S. Circuit Court of Appeals ruled that a hotel president was personally liable for multiple wage-hour violations. The court found that he "was not just any employee with some supervisory control," but that he "had ultimate control over the business's day-to-day operations," and was "instrumental in 'causing' the corporation to violate the FSLA [Fair Standards and Labor Act]." Chao v. Hotel Oasis Inc., No. 06-1021.

In September, the 5th Circuit established new law by holding that a public supervisor can be held personally liable for retaliation against an employee. The case involved a woman who claimed her boss retaliated against her, refused to grant her leave under the Family Medical Leave Act and fired her. Modica v. Taylor, No. 05-50075.

YO IN this sound like someone we used to know? How many people at CNG had their jobs posted while on FMLA I can name at least a few? Can you hear the thunder coming CNG?

Tennessee is an employment-at-will state, which means an employee can be fired at any time for any reason. But in 2002, the Tennessee Supreme Court announced a new tort in a case that involved a supervisor accused of discrimination. I was with the company for 10yrs. I can agree with all that you are saying. All the dirty low down things that go on. I also would not cooperate with the things that they wanted us to do. I left due to the stress and pressure that they were putting on me. The RVP/ROM tried to go as far as to bribe other managers to lie on me to get me out of there. I quit so not to have anything on my record. I contacted HR and of course nothing was ever done.
I think that there should be a huge law suit against them! If anyone needs backup, get in touch. I saved all the dirty little memos and faxes on them that if they continued to try and make me miserable I shall throw rocks back!

I have just left check n go 2 months ago and I have done alot of research on the "non-compete" If you go on the internet and read up there are so many reasons why it would never stand up in court! Also check n go is "at will" and in some states such as Calafornia and Florida the non compete is not enforceable at all. Most courts nationwide frown upon the "non-compete" and it is referred to as a "bully contract" so much to see if you research.

Well there is one started in CA there is one in process in IN and it is moving forward. You can contact phil@severlaw.com he is working on a case now and taking on people for his class action suit.

Thanks for the info BB2Y, I have probably several x-employees that we know would be interested in this. I have sat here all day reading the past few months on what you guys have wrote. I could spend a day writing my experiences with CNG. I got out just in time due to my Drs advise. CNG was aware of my health and used that to push me to the max. Anything I can do to help would be my pleasure, I would love to see it when the big ship sinks.

Check 'n Go, a nationwide payday loan company based in Ohio, asked employees to sign a dispute resolution agreement requiring arbitration of employment disputes, including claims that the agreement itself was unfair. Check 'n Go didn't explain the agreement to employees or give them the opportunity to opt out of it.

Now, in Murphy v. Check 'n Go of California, Inc., Calif. Court of Appeals (Dist. 1) No. A114442 (2007), a California appeals court has affirmed the ruling. The appellate court tracked the reasoning of the California Supreme Court in a recent case involving class action waivers in wage and hour lawsuits. There, the high court had ruled that the following factors had to be examined to determine a class action waiver's validity: (1) the size of the recovery sought; (2) the potential for retaliation against class members; (3) whether absent class members may be ill-informed about their rights; and (4) other obstacles that may make individual arbitrations not feasible

Thanks....I have sent a message. I was just wondering after reading his info, how many more of you guys travelled without pay? How many of you lost your vacation due to shortage on staffing? I know I was done at christmas when they took away our christmas bonus, as far as their "years of service gift" I called and told them they could keep it. I had travelled 1 1/2 hrs a day extra to cover a store for 5mths, no mileage and not on the clock. Wow....I am so glad I found you all on here.

LEGram, I have been trying to figure out who you are and I may, I could be wrong.
Does your name start with "H". I may not know you guys up there, although I have been to corporate several times. I used to be a DDO back in 1999. Should have left then. Did anyone read the recent stories about Michael Vick. He was the football player convicted of running a dogfight ring. The NFL had agreed to pay him a bonus and when Vick was convicted the NFL said they shouldn't have to pay him. But the courts upheld that if the conditions leading to the bonus had been fulfilled then they bonus must be paid even if he was incarcerated. I wonder if that goes for our bonuses too. IF we did the job we earned it whether we were there at the time of payout should be a moot point don't you think? Once earned it is due? Anyone else know about this or have any other info?

Had to change all my phone numbers. I got an e-mail thretening me and ALL of my family with >>get this>>killing us if I didn't co-operate!! Not sure if anyone there had anything to do with it, but I filed an immediate police report and the IP address was traced. It was already shut down, but it did originate in Cincy. somewhere. I'll try and call you this week, I still have all numbers!!

Since Corporate does monitor this web-site, they full-well now who I am and I couldn't care less. I was very instrumental in helping to get HB545 passed thru my testimony to The Ohio House of Reps. The Senate passed it last week and I will be there when Gov.Strickland signs it! It really ticks them off because I was extremely careful not to say who I worked for. I traveled to numerous other stores without pay. (Some 72 miles one-way:clocked in when I got there and clocked out when I left) I was the point person to my "good" DDO. I did store audits, troubleshooting, training, interviews and whatever he needed whenever he needed. He tried to pay me traveling time, but Corporate refused it. I lost vacation several years in a row (never paid for it). I lost all accumulated sick time (amounted to 2 full years of hours accumulated) and a $1600 bonus earned, because I was gone when it was paid out (to the person that replaced me). Good company right >> NOT!!!!

The more people that contact the attorney handling this lawsuit the better it doesn't matter what state you are in they can lead you, they are aware this is countrywide problem and were told ahead of time this could explode when it was filed. The issues you all had are countrywide the same as the rest, CNG does not want anyone that knows the differece between right and wrong and that they violate REG Z. The people they are hiring from Blockbuster most don't even know what a REG Z is and that is what they are looking for. We were told in our state to "hide" the contracts in the daily files in direct violation of state specific laws cause they didn't want anymore fines from the state but then they changed that when the state caught them this was okay with the DDO's because none of them had been there long enough to know better.

The issues you all had are countrywide the same as the rest, CNG does not want anyone that knows the differece between right and wrong and that they violate REG Z. The people they are hiring from Blockbuster most don't even know what a REG Z is and that is what they are looking for. We were told in our state to "hide" the contracts in the daily files in direct violation of state specific laws cause they didn't want anymore fines from the state but then they changed that when the state caught them this was okay with the DDO's because none of them had been there long enough to know better.

I sent back all of the signed paperwork and haven't heard anything since. There was supposed to be a conference call last Wed., but never heard as a follow-up about it. Will let all on here know when the new HB545 in Ohio goes into affect!!! I will post the web-site for all to read. I Will know after Tuesday (in 2 days) the exact date!!

They were probably tweeking the docs they were filing it looks like that was done on Friday so hopefully now they will be getting back to the rest of the people I know we are also waiting for them to contact us.

Roy and Furgason et al. v. Check 'n Go, et al. Represented a class of customers in the United States District Court for the Southern District of Indiana. The case was brought against a company and its owners and operators who made short-term, high interest loans, commonly known as "payday loans." Plaintiffs contended that the transactions were usurious loans that violated the Indiana usury laws, the "collection on unlawful debt" provisions of RICO, and the Truth In Lending Act. The case was settled on a class basis for the payment of $2.4 million in cash, the forgiveness of approximately $3.46 million in debt owed by the class (a total economic value of $5,860,449.00), and the discontinuation of the subject transactions by the defendants.

I never heard about this one either. Do you know what city it originated in?

It was in the Southern District still searching if any documents were filed or if this was settled prior to filing. Sorry I have located some other things while investigating this that have got me sidetracked I admit but I will avoid the shiney things and focus on the task at hand.

No...I was in southeast div. It was back in 99 when the company was actually o.k.
I too lost alot of vacation, pay raises, (due to the changes in policy, whatever.)bonuses, travel pay, etc. I did come to ohio I thought maybe you and I would have seen each other at managers rally? I did attend Orlando few yrs back.
How do you guys get in touch off of here? Not that I care who is on here as it would have been obvious from the beginning.

Did everyone in IN know that ST was a DDO on August 20, 2006????? I always thought BM was the DDO until 9/2006 and acting ROM and DDO until 11/2006 court papers don't lie
