Unfortunately, unless you had a co-worker or co-workers to back you up on this they will go with the employer everytime. Did you keep records on when this happened? I too went through the same situation and I lost!!! My situation was very ugly and the other co-workers were told if they said anything, they would lose their job. Good luck and wish you the best!

Most of the time, it appears that these hearing are a monumental waste of time. The hearing officers are going to side with the employers, who often are politically connected, and if they are a major employer, you can just forget it. Even when you have a racist unprofessional obnoxious management team, you get nowhere without witnesses, who are trembling in fear of losing their jobs if they dare speak up in support of an employee who has been unfairly dismissed. It's shameful that these people are allowed to get away with this, but that is what happens

Hey, Tammy. Usually, you'll get it after you claim the next week's unemployment benefits. If you've signed up for direct deposit either at a GA DOL center or online, you should have your money in your account no later than 2 days after your certification day. Just go online after you certify next week and click on the 'inquiry' link on the main certification page, put in your SSN and PIN. It should show the status as "$xxx.xx was forwarded to your account" for all of the weeks you've claimed. Once it states that, the money will be in your account within two to three days.

I was the office manager at a firm for 4 years. They hired in a new General Manager. He was very intimidated by my knowledge. He often criticized my work, etc. One day, he cut my pay by $4/hr. and gave it to another MALE EMPLOYEE who just started 6 wks before. I questioned him. He said we were "cutting back". I gave other means of saving the company money and he told me basically, Take it or Leave it! I told him I thought it was discriminating and told him I would think about it... saying "This is CRAP!" as I walked out -- at 5:15pm on a Friday afternoon. I received an email from him SUNDAY EVENING saying that I was on PAID Administrative Leave. He said he would let me know when to return back to work. I got an email Monday afternoon stating that I needed to be in the office at 9am on Tuesday. When I arrived, he said "I was really hoping you would've called me over the weekend"... then gave me my separation paper. I didn't read it until I was already home -- I was IN SHOCK! NO WRITE UPS IN OVER 4 YEARS! OH MY!!!! I read the papers after I stopped crying... it was for "GENERAL MISCONDUCT/ABUSIVE LANGUAGE" There were NO WITNESSES! Only me and him... he had even started off the meeting by telling me that it was "his" office now and that he could do whatever "he" wanted to do... He even chuckled and explained that he had been accused of sexual harrassment at his previous job, but it couldn't be proved.... INTIMIDATION!!! ANYWAY... I filed for unemployment benefits... I was DENIED. I have since requested an appeal... What do you think? Is this something I can win?? He totally lied about this! I never received any type of conference over my actions (yes, I cried too - but I've had major financial issues in the past year... ) Is crying considered misconduct? Is the word "CRAP" considered abusive language? Everyone at the office used the "f" word constantly... I didn't, but it's like he's saying I did! What do I need to do!? It's my word against his! How can I prove this?

I honestly believe you can win. The worst they can tell you is 'no' but, it doesnt ever hurt to try. If you can prove, either with or without witnesses, that you quit for a good work related reason, which from what you've provided, is, I think you have a good chance. If you havent had any write-ups in over four years of employment with the company, subpoena the company for your employee records, if you feel your work record will be of good use to you during the appeal. If you have any email communication between the two of you, that will help, forward them to the Dept. of Labor Appeals Tribunal. Regardless if noone witnessed the conversation between you and him, do you know of any other people who, either are still employeed or not employed at the company, who can testify about his character? If so, ask them if they can be of witness during your appeal hearing. I think that would be helpful. Good luck!

I got employed through a temp agency in Jonesboro, GA in Jul 2010.... My assignment ended Oct 8th 2010... On that date I asked for another assignment... there was no more work available (unable to pay my rent I got put out of my apt and forced to move to Smyrna GA) so I filed for unemployment... I got denied because they were claiming that I didn’t ask for another assignment (and I did) so I filed for an appeal... I had the appeal hearing Dec. 7th 2010... They openly admitted that I DID indeed ask for work when my last assignment was over but I didn’t continue to ask for work on a weekly basis so my appeal was denied. I told the judge that I got put out of my apt and moved 30 40 miles away from the area so that the reason why I didn’t continue to call in...Through this 3 4 month period I have been looking for work at other temp agencies just not the 1 that I was working for between Jul&Oct... Should I have won this case???? Thank you for your time!

Greetings everyone,,I am new to this blog but I need some advise please. I won my first appeal hearing which my employer(Federal Govt)for 24.5 years did not show. They are claiming they thought it was a telephone hearing so they have appealed it again!
but the language the Human Resourses Specialist used was not professional at all. One of the statements was an appeal is warranted in order to ensure prudent use of taxpayer monies.
But before that this statement was made
Perhaps if this office was contacted, the electronic coordination would have clarified telephone versus in person.
SHE MADE THE COMMENT "OUR ONLY MEANS OF APPEAL APPEARANCE IS VIA TELECONFERENCE"
now when they start making the State of Georgia mind them. Sounds like the DOD is punishing them as well as myself. any recommendations??

Unfortunately not if you did not contact the temp agency on a weekly basis.

I had a phone hearing Thursday and received a letter the next day on Friday that I won the case. I was VERY surprised at the quickness of the decision though I will say my employer really had no case and my situation was very cut and dry in my favor.

Not everyone in the world can be like you. You obviously understood what she meant. However, I can't figure out what "loclinic cal" means and I have a BS and part of a masters degree. We had our GDOL Appeals hearing this morning. Or rather, my husband did. It was for him anyhow.

His previous employers were a no show.

Employer no show is a good thing. It should be okay. However, they could come back and say they didn't get notice. WARNING!!! If that happens, they will set it for hearing (their non appearance), then do at the same time a hearing for the benefits. So if that happens, BE PREPARED to defend the benefits claim. (You will not get another chance). I had that happen.

I had my phone interview on Tuesday. Employer sent in letter stating that they would not be participating in interview (they are okay with me receiving benefits). Does the rep at time of interview reveal the decision or wait for letter to arrive? How long before I receive decision in mail? Will the benefits site show "paid" prior to letter be sent out, if it was in my favor?

On saturday I received a letter i have to file an appeal. i am very confuse and scared. The benefit keeps a roof over my head.
I am facing my first unemployment hearing appeal process. Since i have never been in this type of situation at all.
What am I suppose to do. I will be homeless in a few week if i do not get a hearing right away. I have been receiving benefit up until now. I have all the documentation to support this action as I am continuing to looking for work.

I was denied benefits after being discharged. I was accused of altering an excel file that would alter my paycheck. I didn't alter this file or any other files, yet because I was suspended I had no resources available to audit my own records to disprove the allegation.I worked hard to prepare for my appeal hearing this morning, and thought I would do well. However,the claims officer reprimanded me several times for either making a statement when I should be asking a question, or stating something more than once. I also referenced the Employer Fact Inquiry in my statement and was stopped and told that I couldn't discuss because the document wasn't brought into evidence. After my statement she brought the document into evidence. At this point I was so confused and distraught that I couldn't remember what I had said, what I hadn't and I know I failed to make several points that I'd had in my notes. I feel like I was railroaded by my employer and now the DOL. I did regain employment last week but told them I had an appt this morning and was given approval to come in late, however the hearing took much longer than expected. So when I called my supervisor to let her know I was on the way,she told me she was leaving early and just wait to come in tomorrow. So after 9 weeks of no pay, I have now lost another day of wages. I think it will be a miracle if I win my appeal.If not, I know I have 1 other opportunity, but I am ready to give up, despite that I've wiped out my savings and won't be able to pay my September house note on time. And we all know that once you fall behind it takes forever to get caught back up. Any advice. I am so mad at this claims officer, because according to the handbook she was supposed to help me through the process. I tried so hard to be polite and nice but I am sure at the end my frustration was showing. Any one else experienced this? Also, my employer still owes me money but Wage and Hour refused to take case - less than $400. $400 is alot.

I just had my appeal hearing. The Store manager that discharged me didn't take the call so she let the district manager take over. He came up with this crazy story about the store manager being on vacation at the time of the incident. And that I challenged a co worker to a fight. I'm guessing the DM wasn't aware of the fact that I had a copy of everything that was sent to the DOL. Hopefully I can win this one based on false testimony from the DM.

I went thru this with Walmart. I said the same. I even told the appeals judge I said it. I win my case but had to take it to the civil court level. Don't let these bullies win!

I had an unemployment appeals hearing on June 2nd, 2016. They mailed out my decision yesterday morning. How long does it take for the benefit inquiry to update in the system? I have been unable to get through to unemployment over the phone to inquire. I had my decision to go to a po box so I just have to get a ride to check it but I thought I would be able to tell online and save a trip.

I'm going through the same thing,i won my appeal 3 weeks ago,my letter states that my career center is supposed to complete the process so I can get paid,they claim its not done there,I even called the appeals board,still nothing its been 12 wks

I called appeal office this morning. The lady that answered the phone advised because of the system outage it has caused a delay with them being able to process anything. Hope this helps

Thanks I actually emailed the gdol and it was taken care of, because when the system was up they still told me they couldn't do anything.

I have no idea. She said system has been down for them since the 17th. I know there website advises of an outage but doesn't go into details. I had a hearing last week Wednesday still waiting on the decision. She said that the system that the hearing officer uses to make updates and send letters they can't get into and they are severely backed up because of it.

I worked with a lot of translators and people who speak different languages. In my personal opinion it appears this person do not use English as their primary language.

I was sent on a job through a tempt agency and one day I notified the employer ahead of time that I maybe late because I had to take my son to hospital the night before(it was just a heads up in case I had to be late). The employer told me to bring a doctor note in but I was 5min away from work before my shift even started I tried to call her to tell her I was already about to turn on the street she wouldn't answer my call. Then I received a call from a text saying contact agency shortly after I received a call from a regular office employee saying to come get my stuff I contacted the agency and filed unemployment afterwards long story short I received a call from gdol saying I voluntarily resigned and didn't follow procedure basically saying I did not ask for another assignment and they also gave gdol the wrong last day worked I sent in the text messages between me and the employer showing I did not quit as well as a screenshot of my phone calls to the agency. Expling on first call i was marked available and second call she had a position available but I reminded her of my upcoming vacation in a few days and she said that position wouldn't be fit for me because they needed someone immediately and I would be on vacation a week so she would notate and to make myself available when I returned. My decision was mailed out today but right now its looking like I was denied.

Hi I am 18 I was hurt on job 1-21-16 so I was receiving workers comp pay than in my opinion my employer fired me 6-3-16 they stopped my workers comp so I filed for unemployment on 6-17-16 employer was a Christian daycare which evidently fell under their church so it was non profit. First they NEVER paid any of my unemployment benefits because in the state of Georgia a church doesn't have to :( sad but anyways Second they claimed I quit voluntarily I DIDNT! So I appealed and finally get a hearing date today at 8:15 am via telephone. I requested it be rescheduled but was denied the request because College class is not an emergency. So I wait and I wait and I wait finally at 8:45 I go on to my next class than at 9:07 they call and want to start hearing my witness had already left for work and I was about to go to class. So she says we will reschedule ???? What they heck is that legal this employer has no investment whatsoever in my claim why do they get to just not show not call. And if it was me no show no call than it would have been dismissed, please tell me how do they get away with this?????

I was initially terminated due to "insubordination". When i filed for UI benefits, i was denied. I appealed this, and was again denied. I appealed my appeal, and after 5 months, the decision was reversed in the appeals tribunal! For those of you out there losing hope, just keep trying. Don't give up. My best advice is to be prepared and just keep claiming. Make notes of the situation immediately after termination, gather evidence. The Employee Handbook from my company helped a lot. Make sure you submit evidence that is specific to your case. I was surprised, but the system actually worked! Of course, i still haven't received any benefits...

I was terminated from my last job the day I returned from having emergency surgery. My unemployment was approved. I've received 4 payments so far. I received a letter last week stating my last employer is appealing the decision. All of the "evidence" they sent in is false and is defamatory towards me. Can u give me any tips on what I should expect? I'm going to get ALL my medical records from my last week of employment due to that being a BIG factor in my work performance that last week. But as far as all the lies they are saying, how can I even possibly prove they aren't true? Also, a week or 2 before I had my surgery, I was injured on the job. My follow up appointment with the workers comp dr was 3 days after my surgery. When I called to reschedule I was told that my employer had closed my case and I couldn't be seen. I do know that it's against federal law to fire anyone under workers comp care.

I totally agree it always sadden my heart to see people go out their way to insult others. You really didn't gain anything writing that post.

I was terminated for the same reason allegedly. I was denied and appealed. I had a representative but he ended up having to go out of town for FEMA once the hearing was scheduled. I'm waiting on my appeal decision. The hearing did NOT go well at all because he was not as prepared as I was and the Hearing Officer seemed so angry and frustrated and said that I could not talk but only there as a witness.I did my best to cover everything in my testimony and I sent evidence before the hearing that she never mentioned and added, although my former employer did reference my evidence. My rep was able to get in that I did not violate any policies and should not have been terminated. I pray that the Hearing Officer considers my evidence and testimony in my favor. I don't want to appeal to the Board. I just need my benefits. Did you ever get yours?

I had my phone interview 10 days ago..I was told a decision was made last Friday and I would receive it in the mail. My benefits still say benefits not paid contact career center. Does this mean I did not get benefits?

Does this mean that DOL will approve and issue unemployment payments prior to the appeal deadline?

The DOL website says that they take 10 days after claim is filed and all required docs received to process claim for payment.But at the mandatory UI class, we were told it takes 21 days.

I filed on 11/11/16. UI class and notarization completed 11/14/16. Notification letter says appeal deadline is 11/30/16. Did anyone have to wait 21 days for payment if no appeal was filed? When I did a certification inquiry, I got this:

Week ending 11/19/16 has been certified and will be processed the next working day.
Week ending 11/12/16 Was not paid. Please report to your career center for assistance.

Since the UI office is closed until 11/28/16, I can't call until then to find anything out re when I can expect to see a payment.

Where does it say that I was denied UI? I assume I won't get paid for the week of 11/12 since I didn't get the affidavit notarized until 11/14. But for the week of 11/19 it's saying it was certified and will be processed. Doesn't that mean that I wasn't denied?
