People are just getting ignorant on this forum. To "K" in Uxbridge, there's a big difference between wanting to work, but being too sick and "not wanting to work (period)". Bottom line is that pregnant women still need protecting in that area, and some people will never see it. To the originator of this forum, don't wait for people to realize it, just stand your ground and take care of yourself and that baby!

Just fired - was in HR and yes.. if you're hourly working at corporate especially -- watch out. If you are salaried you're in another class altogether. Hourly associates at corporate are stowage - 3rd class and are blatenly treated as such. I went through the proper channels to dispute a review and they turned the investigation on me. If you look hard enough you can find anything on anyone. Don't EVER TRUST HUMAN RESOURCES.. they are the anti-christ!!!!!!!

I know how you feel. I was a ccashier and didn't get a promised promotion because I was pregnant! Then I got a lot of crap because I had morning sickness and had to pee mor than once a day. I called in because I couldn't get out of bed and was told I needed to go to the hospital and bring in a note or i'd get in trouble. I was told twice that my job was on the line because I threw up at work and fainted once. Appearently pregnancy is just a phase a woman goes through that hinders Home Deopt's money making. I've heard that there are a lot of people that are upset with the way Home Depot is run. They promise a lot and deliver nothing. Now I woun't even shop at one because not only do they treat thier employees like crap, they treat thier customers like crap too.

Right or wrong, if you read their "bible" close enough, in most cases, it'll say "at will employment" which means they can let you go for whatever reasons they see fit... At times, they don't even have to give you a reason... It all depends on what state you live in as well so if I were you, I'd definately seek legal advise...

That is really strange. Here in Canada, we go by the point system as well but most people in our store have over 30 points. It's hardly taken serious here and they only use it to their advantage when they want to fire someone. I was always late for a couple months and I just got laughed at....

In Pennsylvania, Home of US Steel, John Rockefeller, Child Labor Laws.... YES... for the most part.

In other states... not as easily dismissed especially when you have a long history of employment with the company... So check your case law champ...

I have been with the HD for 8 years. I have a degree in my field of expertise. I was employee of the year my first year, and employee of the month at least 4 times since then. I recently injured myself at my second job, and now I am looking at termination. I know about the way they spin things, and am actually very afraid to post my story. I have seen the best workers go down in flames because of a management that picks favorites. Is this site safe enough that I won't get fired if someone from my management gets a whiff? They are like that you know....

I can't say anything about what a member of management would do if they saw this site.

But trust me on this part, Home Depot "Legal" couldn't care less what occurs online and in certain forums. They are going to be the same zany screwey bunch we all know and love regardless of what goes on here.

As far as what a member or Store management or Regional Management would do, who knows? Some people take it personally.

If you've been with HD for 8 years, why not just file for FMLA leave and claim your 12 weeks... that gives you a bit of a cushion at least.

If not let us know, I don't personally know anyone in Utah who handles FMLA ... so I don't know if I can help. But yours sounds more like you just need a leave of absence.

ok well. first off. the forum is getting very ignorant because there is some very ignorant people in here. i know im a man so most of the harsh comments most likely are men (sorry for the bad spelling)you ladies need to seek help. it is wrong for home depot to treat employees the way they do. i used to work there but guit. my reasons are far different i assure you lol. you women are a help to the world by bringing little joys of life and a life of joys dont let the coporate offices
( mainly of men ) take your freedoms away. i dont know if this may seem harsh but is more of words of incuragement. STAND up for yourselfs and take action. because if you dont my fiance may deal with the same in the future as well as other women or your daughters. women have the power to change there freedoms not man.

When I first injured myself I had to be in a wheelchair. I was still working 40 hours a week at Home Depot and picking up hours at my other job. I was being scheduled by myself a lot of times in my department, and it was impossible to remain non-weight bearing as my doctor was adamant about. After the second visit with my specialist (a month and a half after the accident) he told me to go on a LOA from Depot to avoid surgery. My HR told me that I had to include the month and a half that I was working 40 hours a week as part of that leave. I have 2 weeks left on leave now, and my xrays are just now showing signs of improvement. I don't understand how if you are in the store, working all your hours in the department you are assigned, how that is anywhere near a leave of absence. Don't you have to be "absent"? What can I do?

Dude you're clueless but then again you are IN THE STATE of child labor and US Steel.

"AT WILL" has absolutely NOTHING To do with rights given an employee of over a year by the Family Medical Leave Act of 1993. So please just stop before you hurt yourself.

ANYBODY I mean anybody out there who has a problem with this offender regarding FMLA meaning you worked for them for over a year and had to take off some time ( you are entitled to up to 12 weeks UNPAID).. Well here's what you do... first off... Find your local US Representative and tell them that you have a FMLA problem... Then call the local Department of Labor and file a formal charge against the manager for trying to tell you that the month and half you WORKED had to be part of your 12 weeks of covered leave.

Document everything in writing.. and if they take any adverse action against you. Email me immediately.. I'll either personally help you or get you somebody who will.

FREE OF CHARGE.. it's on me b/c this group deserves a little "friendly" review.

I was recently off work for medical reasons of depression-i have all the appropriate paperwork from my doctor & they suggested that i fill out FMLA paperwork ( my HR did not offer up the info. i researched it on my own ) when i asked my HR she did not feel that i would qualify due to my condition. But, my doctor says otherwise...so, i requested the paperwork - provided the info. from my doctor and i am still waiting for this to be completed by my HR...she just keeps giving me excuses.. I am out of sick time and the points are racking up...what do i do.. At this moment i am ok - health wise, but this is an ongoing condition. I just want to secure my job, i have been with them for several years now...and yes......do not trust your HR..

Do not specify your condition or offer up ANY other information concerning the nature of your requested UNPAID TIME OFF...

Once you do that if your Managers have any QUESTIONS tell them to contact Kenneth Barr in the Employment Law Division at 2955 Paces Ferry Road in Atlanta Georgia if they have any questions and Mr Barr will be very helpful in advising the management personell of your rights under the ACT.

Trust me on this because I've been educating Mr Barr Personally and will continue to do so on your behalf over the next year or so and they WILL NOT Want to deal with another one of me again <g> .. This happens when you unknowingly wrongfully <g>

YOUR HR does not have to fill out anything on your behalf... You can simply send a letter personally to the Store Support Center Employment Law division... Email me if you want the Fax number.

You do not have to rely on HR to deal with the corporation who acts as your employer.

TO MAKE A LONG STORY SHORT I WORKED FOR "THE HOME DEPOT" FOR THREE PLUS YEARS. I LOVED WHAT I DID, I WAS IN THE GARDEN DEPARTMENT AND A CASHIER PLUS SALES. I WORKED FULL TIME 40 SOMETIMES PLUS HOURS A WEEK. AFTER THERE SIX MONTHS I WAS ABLE TO GET OFF PROBATION AND BUY STOCK. MY LIFE WAS TURNING FOR WHAT I THOUGHT THE BETTER. I WORKED ALL KINDS OF SHIFTS. THE PLACE EVEREYONE WANTED TO BE WAS ON THE CONTRACTOR'S END DUE TO THAT WAS WHERE THE MONEY WAS AT, BUT I FOUND THAT HAVING THE KNOWLEDGE AND EXPERIENCE WORKING AS A HORTICULTURALIST AT A WHOLESALE AND RETAIL PLANT NURSERY I BELIEVED I GAVE THEM A RUN FOR THERE MONEY, EXCEPT IN THE WINTER. THEN AFTER ABOUT MARCH OF 1998 I HAD REACHED MY 6 MONTH MARK. I RECIEVED MY BENEFITS PACKAGE AND WITH MY FATHER'S SUGGESTIONS APLIED FOR SHORT TERM DISABILITY AND LONG TERM DISABILITY. I DID NOT FIND OUT I WAS PREGNANT THOUGHT THERE WAS SOMETHING ELSE CRITICALLY WRONG WITH ME LIKE CANCER OR SOMETHING. IT WAS MY FIRST CHILD. I NEVER THOUGHT I WAS PREGNANT BUT COME TO FIND OUT HAPPY BIRTHDAY I WAS SEVEN MONTHS PREGNANT. I KNOW THAT THINGS WERE JUST NOT LIKE ME TO THROW UP FOR NO REASON SOMETIMES AND WITH HIM IT WAS LIKE THAT. BY THE SEVENTH MONTH I WAS EXHAUSTED AND COULD NOT DO WHAT I USUALLY COULD DO LIKE CARY 50 TO 100 LBS OF POTTING SOIL FOR CUSTOMERS AND LOAD CARS ALL DAY. WHEN I FOUND OUT I WAS PREGNANT MY SUPERVISOR BY EIGHT TO EIGHT AND A HALF MONTHS ASKED ME IF I SHOULD NOT THINK OF TAKING THE NEXT FEW WEEKS OFF DUE TO THE BABY BEING HERE SOON. I TOLD HER I WAS OKAYE AND I COULD NOT AFFORD TO STAY HOME. WE WERE JUST STARTING OUT. THE GYNOCOLOGIST WAS WACHING ME CLOSELY AND TOLD ME WHEN I FELT LIKE I NEDED TO TAKE IT LIGHT I WOULD KNOW. THEN THERE WAS ANOTHER GIFT THIS TIME I KNEW IT HAPPENED. IN DECEMBER I WAS EXPECTING MY SECOND CHILD. NINE MONTHS LATER, NO BENEFITS, NO JOB, AND FIGHTING WITH THE EEOC FOR FMLA. AND AT NINE MONTHS PREGNANT COULD NOT FIGHT ANYMORE. I HAD TO HAVE AN EMERGENCY C-SECTION WITH MY FIRST THIS TIME IT WAS PLANNED AND I WAS GOING TO TAKE CARE OF MYSELF A LITTLE BETTER. I STILL FELT BAD AT NINE MONTHS BUT AT LEAST I KNEW WHY THIS TIME. WHILE MY STORE MANAGER WAS ON VACATION I WAS SICK AS A DOG WITH THIS PREGNANCY. I BENEFITS THROUGH WORK I SPOTTED A LITTLE AND CALLED THE DR. RIGHT AWAY. HE SAID STAY HOME PUT MY FEET UP FOR THE DAY OR TWO SEE IF THAT HELPS IF NOT COME IN TO SEE HIM RIGHT AWAY. But I'm trying to piece together your information. How long did you work for the company?

It says in one of your posts that you had no benefits.. etc.. and something referring to 3 months? Was that your 90 day review you are referring to in that ?

I'm simply asking to see where you stand. Please try to keep the emotions out of it.. I know it's difficult.. they really piss me off too .. and tell me exactly what happened.

How long had you worked for them.. were you given any warnings.. what did you do? how long ... etc etc..

Ok I'm sorry I had not seen your initial comments... so you worked for them for over 3 years? ... and your date of discharge was when exactly? 1998?

You're confusing me because in one section you state you had reached 6 months with the company and applied for short term disability.. but before that you state you had worked for them for 3 years..

What was your date of hire? What was your date of discharge? approximates are ok.. month and year.. thanks.

Just on a very basic level... The statute of Limitations for asserting a FMLA claim are 2 years from the date of the offending incident....

And for matters where there is a "willful" violation of the act by the employer the statute is extended to a period of 3 years.

If you have not pursued anything in what you claim to be 5 to 6 years.. then your claim would be barred. However due to the nature of your post... It was unclear to me whether you were ever entitled to FMLA benefits or a covered employee at all.

In order to be a covered employee you must meet the requirements specified in the statute and although your post refers to several years of service.. you seem to refer to a 90 day probationary period and or a 6 month review as the time when you sought your short term disability... at this point you would not have been a covered employee under the Family and Medical Leave Act and would not have been entitled to it's protections.

Ok Bink. So you were a covered employee and this all occurred after 1993.

Hmm. Now what was the date of discharge? I'm no expert on the actual application of the statute of limitations in FMLA cases.. so I'd have to go review the statute itself because I believe it's expressly stated as two years from the date of incident.. and that figure gets extended up to 3 years in cases of willful or malicious violation of the act.

However, I'm assuming your cases arose from Employment in Florida? You'd have to consult someone more familiar with Florida State Law concering pursuit of a claim of wrongful discharge in direct violation of established public policy. This is a claim arising from Tort Law and does not rely on the federal statute however just as with the statutory claim... there are often limits imposed upon the time frame from the date of offense that you are permitted to bring a claim.

Do me a favor and email me ... then I can fully examine what's going on or has gone on.

So far however it seems as if they granted you the 3-4 weeks you had requested... and this time would have been characterized as FMLA leave..

FMLA leave guarantees that you are entitled to up to 12 weeks in any one year of UNPAID leave without losing your job and that they have to reinstate you to your job upon return.

It would not however require that the company pay you during that time. What are the exact facts surrounding your actual termination.. if you prefer just email me..

The way you would go about this would have been to contact the local office of the Department of Labor and they will investigate allegations of FMLA abuse... then you'd have the option of bringing a private lawsuit but there's no obligation of the DOJ or any government agency to bring the lawsuit on your behalf.

Your main problem will be I believe that you have exceeded the statute of limitations

And Bink don't get me wrong... I'm on your side with this.. I'm in the middle of it myself.. I'm just trying to be honest about what could be done from a "legal" standpoint in your particular case but I'm not telling you what you should or should not have done...

What your facts would however testify or support would be whether this is a company wide problem... and if necessary your story could be instrumental in other matters so don't be discouraged yet...

Obviously if it's been this long, you feel that something severely wrong went on while working for this company.. and I fully understand how you could have been put in that position..

At the same time.. I don't want to be dishonest and give you false hope of the situation.. that's why I'd like to know the exact story of how the termination came about ... but these are very personal , sometimes traumatic incidents, so if you don't wish to relive it.. it's completely understandable.

I BENT OVER BACKWARDS. SO DID THE BABY POOR THING. HE BONDED WITH MY SISTER VERY WELL, SO WELL THEY HAVE THAT SPECIAL CONNECTION. ANY MOTHER WILL TELL YOU THERE IS A LOOK THAT A CHILD GIVES THIS LOOK TO ONLY ONE AND SHE GETS IT I DON'T. I NEVER WILL. EVEN MY FELLOW WORKERS TRIED TO TALK TO ME ABOUT SOME THINGS BUT I JUST SHRUGGED THEM OFF TO ALL I HAD TO DO WAS WORK AND GO HOME. WHEN I WAS AT WORK THAT WAS WHERE I WAS AND WHEN I WAS AT HOME I WAS AT HOME WITH MY BABY, I WAS JUST FINALLY GETTING USED TO IT. REVIEW TIME CAME UP AND I WAS NOT EXCEPTIONAL...JUST GOOD REMARKS. DUE TO ME BEING OUT A FEW WEEKS AND OUT DURING SICKNESS THE POINTS WERE DOCTED OFF, BUT I WAS NOT GOING TO BE REPREMANDED, THIS WAS JUST NORMAL AND I WOULD BE FINE WITH THE COMPANY. I DID JUST THAT SIGNED IT AND WENT BACK TO WORK. PEOPLE JUST DON'T UNDERSTAND THAT PEOPLE THAT HAD BEEN IN SALES AS LONG AS I HAVE BOUNCE ALOT. IF YOU WANT ME TO LEAVE THEN SAY... I WANT YOU TO LEAVE. IN LOUISIANA (RIGHT TO WORK STATE) THEY CAN PRETTY MUCH SAY THAT AND GET AWAY WITH IT. THIS ALL HAPPENED IN LAFAYETTE, LOUISIANA. I LIVED THERE FOR 20 YEARS TOTAL. I WAS AN ADOPTED CAJUN. AND LOVED IT THERE. FOOD IS AWESOME. SO ARE THE PEOPLE. ENOUGH ABOUT THAT... I WAS STAYING AT WORK NOW AND GOING EVERY DAY FOR MY FAMILY AND MY CHILD. HE HAD THE BEST DR. AND THAT WAS BECAUSE OF INSURANCE THAT WE HAD. HE SAW THE DR. (PED.) FOR MOST OF HIS CHECK UPS UNTIL I NEEDED OFF FOR SOMETHING THAT I HAD NOTICED WITH BRIAN SINCE HE WAS BORN. HIS LEGS WERE NOT STRAIGHTENING OUT. I MADE AN APPOINTMENT WITH THE PEDIATRICIAN AND TOLD SUZANNE. SUZANNE FLIPPED SHE HAD TO REARNGE HER SCHEDULING FOR THE NEXT WEEK AGAIN. I GAVE HER A WEEK NOTICE THOUGH. I DID NOT UNDERSTAND AND TOLD HER IT IS A DR. APPOINTMENT FOR MY SON.

I HAD TO GO OVER HER HEAD SO I ASKED BRAD THE DEPT. MANAGER. HE ASKED WHY AND HE SAID HE WOULD TALK TO SUZANNE. I GOT THAT DAY OFF. I DID NOT KNOW IF I NEEDED THE WHOLE DAY BUT AS IT TURNS OUT THE DR. SAID WE MAY WANT THE SHRINER'S HOSP. TO LOOK AT HIS LEGS SO WE MADE THAT APPOINTMENT AS WELL WHILE WE WERE OUT THAT DAY. ALL PAPER WORK WAS COPIED AND GIVEN TO THE DEPT. HEAD SUZANNE. AFTER ABOUT A WEEK AND WORRYING ABOUT THE BABY, SUZANNE CAME UP TO ME AS I WAS COUNTING MY TILL AND SAID, "I WILL HAVE YOUR JOB, BET ON IT!" NOT LOUDLY AND OF COURSE NO ONE ELSE WAS AROUND OR SAW ANYTHING. I WAS ASTOUNDED. BUT HER WORD AGAINST MINE. LIKE THEY WOULD THINK ANYTHING ABOUT IT. I KEPT MY MOUTH SHUT. THAT IS ALL SHE WANTED ME TO DO IS GO OFF.. I WOULD NOT. I JUST THOUGHT ABOUT GOING HOME TO THE BABY AND MY HUSBAND. I WAS EXHAUSTED BY THE TIME I GOT OFF WORK. THEN ONE DAY WHILE AT WORK I FELT A LITTLE QUEEZY. NO THE SECOND BABY WAS NOT PLANNED EITHER, BUT AT LEAST WE KNEW WITHIN ABOUT THREE WEEKS. I STARTED TO GET SICK.... REALLY SICK. EVERYMORNING AS SOON AS MY HEAD GOT OFF THE PILLOW TO EVERYNIGHT AFTER DINNER. TWICE SOMETIMES THREE TIMES A DAY. NOTHING HELPED. VITAMINS MADE IT WORSE. I JUST HAD TO MUTTLE THROUGHT IT. ONE NIGHT WHILE AT WORK I STARTED TO GET SICK. I WAS GAGGING.. OVER NOTHING I DID NOT EAT, EVEN THAT BOTHERED ME. I TOLD THE HEAD CASHIER FOR THE NIGHT I NEEDED A BREAK. I WAS NOT FEELING WELL, SHE HUFFED BUT SAID OK. I SHUT DOWN THE REGISTER AND JUST CROUCHED DOWN BEHIND THE COUNTER FOR A FEW MINUTES HOPING TO HAVE MY HEAD BY MY KNEES WOULD HELP. NO BUT GOOD TRY. THEN DECIDED TO WALK OUTSIDE BEHIND THE BUILDING TO GET SOME AIR FOR A FEW MINUTES. MY HUSBAND SHOWED UP TO CHECK ON ME.
