It is dependent upon the mistake & how long ago it was. Depending upon what the mistake was -- some mistakes can be expunged from your record after a certain period of time. My advice would be to contact an attorney or the courthouse and make some inquiries. Google record expungements with the state name and start from there, so you will have a better understanding of the laws in place. Always be honest on your applications as your credibility will be questionable regardless.

You are quite welcome. From what I've been reading you don't need an attorney to file for a petition to expunge your record. There was one site that stated what could and couldn't be expunged. Think positively and know that someone out there "will" not hold your past against you. And remember -- no one person is perfect in this world. We have all made mistakes in one way or another.

How extensive of a background check will they do? I did something stupid a few years ago but was never "convicted". However, I'm still afraid it will haunt me for the rest of my life.

Jobhunter in St. Louis: You need to do a google for expungements also - there are stipulations that apply for convicted or not convicted. In Maryland, some stay on your record for a minimum of three years, however, it is in your best interest to file a petition to have those records expunged at any rate. From what I have read they will be sealed, however, if you should do something stupid again, that will count against you. As far as how extensive - it all depends on what you are applying for and to what capacity of trust level they need.

I am a firm believer that I was put on this earth to help others & I do it because everyone needs someone to be there when their mind has gone blank on what to do next. I have been fighting for my home for 16 months, trying to find a full-time permanent position w/in the govt. as it seems to be the only 'secure' workplace these days, and dealing w/it all on my own. However, I am always able to assist others when I can. Thank you again!! :)

Mike: Right back at ya! Remain confident that there is light at the end of the tunnel. It may be hard at times, but face it head-on & deal with it in the best way you know how [that way it doesn't fester] The world is a very judgemental place and I make it a point to never judge anyone, as I am not living in their shoes, nor are they living in mine. I wouldn't wish anyone to go through what I have and am now going through - but if I can help one person out there, even if it is a very small thing, it makes me smile and it does my heart good. Afterall, it is always the little things that can make the biggest difference.

I am still on probation for it (sentenced to 3 yrs probation but not convicted). I believe I will be eligible to go off probation in Sept. However, when I did an online background check nothing came up.

JH: Talk to your PO then -- the PO should be able to assist you or at least make the inquiries. But also do your homework and read up on what you can do. There are companies out there that do help people who took a wrong path and learned from it -- being sincere is key. It may seem like a 'womanly' thing but macho-ism wouldn't benefit. I will look and see if I can find anything out too. When you are in it -- it is more difficult to see beyond what you are dealing with.

I actually was just hired by Ikon on 4/29/07. I was told by the manager that hired me that all the paper work is done and my first day is 5/1/2007. I worked at Ikon on 5/1/2007. That evening I recieved a call from the hiring manager saying that I am no longer an employee because I failed my background check dispite the fact that he had already told me all the paperwork is done.

The only conviction/arrest I have had is a misdemeanor tresspassing. I told Ikon about the Trespassing charge and they said that was fine. The background check company Ikon uses reported that I was convicted of 2 counts of misdemeanor assualt, which is untrue. I disputed the report with background check company and Ikon. Ikon only gave me five business days to prove these charges were false. The only way I could prove that these charges were false was to obtain official court docs from the county. Unfortunately, it takes the county 10 business days to process the court docs. When I explained this to Ikon, they said I cannot get an extension on the background check dispute and the only way I can get the job back after I prove the false charges is to re-apply for the position.

On 5/12/07 I cleared everything up with the background check company and Ikon. The hiring manager has told me several times that he will hire me as soon as a position becomes available and that I should re-apply online then.

Today is over a month later and all I have heard from Ikon is two rejection emails for the same position I was originally hired for.

Mike: Try to remain positive -- if they are going to judge you by a mistake that you made yet already paid for, then they are not where you want to work. No, they don't have hearts and that makes them very imperfect. Work on getting it expunged from your record but find another company to work for. Hang in there!

Then file a formal complaint with the EEOC. Explain everything you did here on this forum. It may not get you the job but it would be a major headache for the company -- and they will be investigated -- and if that is how they treat you AFTER you cleared up the error -- then maybe you may not want to work for them anyway.

I applied over a week ago with no criminal record and have an extensive sales and customer service background and have never been even acknowledged so dont feel bad when something is meant to be nothing can stop it. I say move on. It wasnt meant to be, wasting time trying to contact the EEOC etc is just that a waste of your valuable time use it constructively. GOOD LUCK
