I recently was hired on for overnight at target. My first night there break time came and I asked where do we go to smoke? The supervisor informed me that there was absolutly no smoking for overnight crew as they are not allowed to open the doors. Is it legal for them to make us clock out for lunch and not provide an out for us. I know walmart and K-mart don't make you clock out so they don't have to let you out, but if a company makes you go off the clock can they still keep you locked in the store? |

They have to take down the entire security perimeter to let you outside the door, that is a big financial risk since all of the security is off. Legally it sounds like entrapment for not letting you out on your off the clock break but i'm not a lawyer so what do i know. |

If you were not being paid then yes, it is illegal. If you were being paid such as the paid 15 minute breaks then they can set whatever policy as you are on their time. |
