Dear all,
Few months ago I was looking for a job closer to my place where I live. I'm a certified Master Esthetician and in beauty business more than 20 years. I was happy to find the wanted place and immediately I sign a contract with one of the well known spa in the area for only 30% commission of the service. Ouch! I know what you will say, but for only 90 days, Yeh, 90 days will go quick just like that and after my " performance Evaluation" we will talk in other terms""... Yes, 3 months fligh away quick and my passion for this job make me forget how much frustrated I felt when after the 90 days I asked about if my pay will be change in a better commission but shortly after I was announced that they are not willing to pay me more even my performance evaluation it is very good, that I'm free to stay but that's it. I believe that I felt like somebody punch me in the stomach, that I need to start over and over again and look for another place. I love my customers I love the advanced technology but also I would like to have something in exchange so I can pay my bills. But the story did not finish. I left the place and I'm not too familiar with the law. I did not stay 1 single day more than 90 days but in the contract it is mentioned that even I will not continue with them for some reason I will not be able to work for the next 5 years 5 miles radius from the place I've been working from now and in the future what ever they will open a new place. Funny, and they just open a new place in another location and now if I will look for another place to work I need to go further and further ... In my knowledge these 90 days, why we call them probation days? To try one to another, and if doesn't work, doesn't work, there is no contract.. I might be wrong. And now the last thing. Looking to my print out of the services I realized that all my services have been "discounted" .For a service of 145$ I was paid 28$. Bride makeup I end up with 18$.LOL.PLS.ADVICE.IF IS LEGAL AND FAI

You need to take that non-compete to an attorney. Most likely, no one here will know what the laws are in Virginia. It seems very obvious that they wanted to get you in a position where you would be forced to stay working at 30% commission on discounted services, which is slave labor. In all likelyhood the non-compete is not legal if you live in a right-to-work state. You need to find out from an attorney if it is enforceable. My gut feelng is that it is NOT an enforceable contract. Get moving on that attorney, or call your Labor Board.

Thanks a lot for the prompt answer.Iwill ask an attorney for sure to avoid trouble. What make me very sad is not the money mater, is the fact that another qualified aesthetician will be the victim for the next 3 months until she will find out the truth. They hire only high qualified aestheticians and all the period of time I've been working with them they never took off the open position for that place from the website. Later I knew why. I was one foot out when already another "victim" was on the 90 days probation...Good luck to everybody!

Some states do not allow this. Many states have laws which protect you because it denies you from making a living. There is also the question of if they violated any part of the agreement. If you knew that they would not have increased the percentage after the 90 days would you have still accepted the position?
Talk to an attorney. What are their remedies if you violated the non-compete?

I wouldn't even worry about an attorney. You live in a right to work state. Nothing they can do about it. They put it to you and you didn't stick around to take it. GREAT FOR YOU! I even had a corporate attorney threaten me over the phone about a dozen times, before they stopped calling. They just try to scare you. If I were you I would work right next to their salon, wait outside for your previous clientele to show up and have them see you walk their old customer into your new salon. LOL JK, but they can't touch you and if you don't want to spend the money on an attorney, don't do it. Put this behind you as a bad experience and go and make GREAT HAIR!!!!

I have a temp NY License and want to work in mass. Does anyone know if I can just pay a fee once I'm licensed in n.y. for the mass license, or do I have to take the Mass state boards?
