If they brought you in, they have to pay (employ)you, otherwise the hospital needs to terminate your position, cancel your H-1C, notify USCIS, and buy you a return ticket. - I agree. The H1C visa was granted to you because the hospital petitioned to USCIS that it needed to recruit a foreign nurse after having diligently recruited American RNs and none applied or none qualified for that specific position. That hospital is MANDATED by law to employ you.
As to lowering wages - it is against the law to give lower wages to foreign recruits. In my case, I get the same pay as a blue-eyed American does.
By the way, I am on an H1C visa and paid NADA, ZERO, NOTHING to any recruiter. I just applied on my own.
I did not know that the employer was supposed to pay the plane fare back home, but now I know. Knowledge is power.

I suggest you exercise your right and get a lawyer, you need to report this matter to the UCIS (immigration) check the immigration regulation for H1C , the sponsor/ employer should start paying you once you reported to work.

I graduated nursing school with BSN in MA, having an active RN license in MA.
I worked in a hospital for one year with OPT but I left my working place because I could not apply for H-1 nor Green card.

Currently I am a graduate nursing student(nursing education) in the Master of nursing, and will graduate in 2010. Does anyone know how I can get H-1 or any possibility to apply for EB2, and hospitals/agencies who support a RN with MSN?

Hi, I am currently working in the said hospital at Chicago, IL. I believed the problem is not with the recruiter/immigration lawyer alone but even with the hospital mgt. Your H1-C could not have been approved unless the hosp mgt approved the hiring and submitted the necessary docs with USCIS. I also paid $4000 to the recruiter plus $5700 via monthly salary deduction of $150. We did not get any receipt from the recruiter/lawyer..am not sure if there is any IRS issue here. We understand there are more than 30 nurses whose h1c has been approved but could not be employed because there is no vacancy. dont worry though, even if you have not started working, USCIS will extend your stay to complete the 3 years.

anyone? someone said that filing of H1c visa is only until December 2009,, can anyone please give me the website that states such? Have you tried consulting with a lawyer? you should find another employer who will be able to petition you right away because if you wait to long the 1st employer might say the same thing 6 months later. It is best you to talk to other employers and a lawyer.

it is a fact that hiring for h1c visa has been stopped. unfortunately, some of the nurses who worked here with h1c visa may go home after their contracts because their contract may not be extended. i suggest that you apply to another countries.

H1C ended last year.... they didnt even renew it.

You need to file for greencard and wait in the EB3 line which will take 10 years to get green card.

Hi there. My case is somewhat similar to those RNs with H1c visa..Just that I am a H1b holder, petitioned by a certain Agency in the US. I have been issued the visa since last year of July (2009) and until now I am still here in the Philippines waiting for deployment. I am just a ticket away to the US, yet my agency informed us they are having a problem marketing us candidates (ICU and ER nurses) to employers. It's been almost a year and the long wait is really disappointing. Time is gold and we should have been deployed by now.

Can you help me find an employer in the US?By the way, I am an ICU nurse with 1.6 years of experience (I could have incurred 2years of work experience had my agency made a bad judgment about resigning last AUgust 2009). I believe I have all the necessary credentials since I am just a ticket away to the US.

I would like to include the information by the way, that according to my agency, in case we find a facility or hospital who will hire us, there is still a need for the employer to agree with the terms of my agency since they are the ones who petitioned us.

Please help. It would be nice to hear from you.

There are a lot of long term care facilities looking for RPNs as well with this US experience. They appreciate the foreign earned credentials. If your cousin would like, she can contact me directly and I can provide her with a few options (including a few online programs she can take).

Find yourself a company that can sponsor H1B, this is available for various qualified professional, not all nurses can qualify.

There are talks in congress that H1C will be extended, and or the Green card retrogression will be lifted. so far nothing.. my best advice prepare for possible need for departure. If your H1C is expiring in less than a year then you really need to see what's your alternative, talk to your HR, your lawyer what are they going to do about it. Some hospitals started to recruit local nurses to replace the H1Cs.. and simply ignore the expiring H1Cs.

There is no H1C visa available. When did you get your H1C visa stamped.... Since H1C program is cancelled it is not possible to get an extension better you try to apply for green card....

H1C visa is retiring. I don't know of any hospital that will sponsor when there are plenty of US nurses and you can't be employed for 5+ years.

I am a nurse here in the U.S, I signed a 3 year contract with my employer, got an H1C visa stamped in Philippine consulate last December 2009, which is valid for 1 year only (I-797C, Notice of Action form states - Approval Notice Class: H1C, Valid from 12/09/2009 to 12/08/2010) which is set to expire this December 2010. But in the port of entry, I was given 3 years on my I-94 which is valid until February 2013. I know that H1C is valid for 3 years and it cannot be renewed nor extended beyond 3 years but I really don't understand why I was given 1 year while some of us was given a full 3 years. My questions are:
1. Which I am going to follow for my period of stay, the I-94 or my visa? Since my visa will expire this December, am I allowed to work legally after the expiry using using our I-94?
2. Since H1C is valid for 3 years? Do we need to file an extension of visa to the USCIS? Since H1C visa has already expired last December 21, 2009, is the extension allowable?
3. If ever our visa can be extended at a USCIS branch, what documents do we need to bring? Also do we need to have an Immigration Lawyer with us?
4. With our case will it jeopardize our pending immigrant petition using our I-94?

hopefully someone could answer this question..

Get a lawyer ASAP, you can not legally work after December 2010. You can not legally work on a tourist visa. The H1C expires in December and can not be renewed. You have to wait until your petition date is current which is about a 5 year wait.

hi! regarding the h1c. the uscis only granted 1 year for my visa which is only valid from dec,2009 - dec, 2010. as far as i know, the h1c is good for 3 years so it means that i still have 2 years to maximize my visa. would it be possible for my employer to file another 2 years for me since im just using 1 year?

If you are out of status you are breaking the law. Your employer can file for H1B, but you need to meet the requirements for that visa which is intense.

am currently working at. st. bernard hospital. i love the place. ya it's true that the area is not that safe as others told you on in here but you can always stay at their dormitory which is located at the hospital compounds. and that is safe. the community is all black people. and they are the ones doing the shootings, gangbanging, and what else. it's not like if you go outside the hospital, black people are going to rob you on the streets or punch you or what not. it's not like that. i do not live in the dormitory. i live outside at the far north side. this area is in the south side. since i started working there january of 2010, i have not encountered getting robbed or shot at yet. i only go there to work. i do not go there to stroll around the area or hang outside. something not good might happen. so if you are cautious like me then you will be far from harm's way. the hospital is full of filipino nurses. majority of the nurses are filipinos. the minority are nurses who either immigrated from africa or from the caribbeans. so you would be very at home if you choose to work here. but as we all know, the H1C visa already closed december 2009. so even if you decide suddenly now to work here because of what i say on in here, it would still be impossible as H1C is closed already.

hi, i m a nurse from india, cleared my nclex rn and always wanted to work in usa as a rn.but herein india, the recruitment has been on hold since 2007 because of recession in usa (told by agencies).its sad that after lots of hard works and hopes ,we r not getting what we have dreamt.there are thousands of nurses in india who has cleared nclex but cant fulfil their wishes.so thats why many nurses go to uk ,australia after giving ielts..as we dont have any option left.please guide us and tell us where we can contact and get some information regarding this.
with your guidance , i beleive that u will fulfil the dreams of thousands of indian nurses who wish to work there.

am sorry the h1c visa all around the country including st. bernard hospital is no longer active. the visa already closed december 2009. my h1c visa is about to expire this september 2011. and i will stay here illegally after it expires.

I am in the same situation as you although my h1c will expire Nov 1, 2011. so you plan to stay here out-of-status when yours expires? please remember that hr1933 has been passed by the US house of reps and is now in the senate. If you are OOS, you may not be able to reapply for an H1c visa WHEN the senate approves this bill.

i am in the same situation as you although my h1c visa will expire end of Oct, 2011. Have you considered the possibility that hr1933, renewing the h1c program, which is now in the senate may be passed and if you are out-of-status, you may not be allowed to reapply for a h1c visa when this bill is approved?
