That's not necessarily true. Most states because of the act passed by Clinton have instituted a pier revue and exemption clause. In Fl if the offense is 2 years old or more you can get an exemption. SC is the best state if you have a felony. After a period of time they will wipe the slate clean from any state.

Ted would probably say NO but you issue will be will the school let you through the program and can you do clinicals because of the felony? I think you need to get the final disposition reduced to a lesser charge not a felony. This can be done through an atty and a hearing with the sitting judge.

it was for peeing in a bush was charged with open lewdness and now considered a sex offender

hey LC3 its not a felony charge or conviction it is a misdemeanor which is maintaining a common nusiance. I currently work at a hospital and they know about the misdemeanor and they said its fine because it isnt a sex crime or a drug charge. Im a surgical tech in the operating room right now.

I work with someone who had a felony. It took him more time to get his license. He also had to provide alot more information and court documents. It is possible, just takes alot longer depending upon the state.

I work with a person who has a felony. It is possible depending upon the state your wanting to work in. However, it took much longer for him to get a license approved and he had to provide court documents and a bunch of other information. I guess I would contact the state licensing board of where you want to work and see if they will issue a license to someone with a felony.

SEX OFFENDER.....i really doubt that any hospital would let you work there or even do your extern. I had a fellow classmate who had a domestic violence on his record and he made it to the 3rd semester when one of the hospitals didnt accept him and he was put out the program. I dont know why schools are able to mislead people and take there money and not tell them of this before they are knee deep in it. I hope your state allows you to work. I can see a misdemeanor random violation but assult or offender. If the hospital doesnt do a background check because they are under the impression the school did..you should be ok. But good luck on finding a job when you graduate, its hard enough to find a job as a new student with no experience. Wenday

I was accepted to a respiratory care degree program and just submitted a pre-determination for licensure statement to the Texas Department of State Health Services. Will I be denied or should I be ready to start the respiratory program?

Getting the license is the easy part. Getting hired on at a hospital is the hard part. I have a felony conviction from 13 years ago, and have been hired twice buy the department but Human resources stopped the hiring because of the conviction. Been looking at all hospitals and the B.S. line of "felony conviction will not bar employment" has kept me from a job. All backgrounds have no time limit! Having to face the fact that I wasted 30k and two years of my life chasing a pipe dream. If you have felony don't waste your time/money with respiratory... you can get the license, but no one will hire you. Just my experience...

You will do a FBI back ground check "livescan" that looks at your entire past record. This goes directly to the RCB so its not really a matter of not disclosing it since its done automatically. Did you get it expunged? It shouldn't affect your licensing since it was so long ago, however a felony is a red flag.

Thats true about its hard enough to find a job as a new student with no experience very hard but harder when you got any major records like a felony charge or misdemeanor,or others like it, and no body has to hire you if they dont want to and you cant take them to court and win srry but I know ppl whos tried it and it wont work because judge sees you have done a serious crime so thier not gana take your side unless you get a really good judge paying lots and lots of money and it taking a long period of time to win the case then you might have a fighting chance just might. Being a sex offender you cant hardly get a job anywhere.be very hard mostly everyone wont hire you cause thats a huge crime,huge. I wouldnt hire some one w a crime like that on their hands unless I knew the person and they really didnt do it.

You living in california Im not entirely sure but if its been that long ago I would worry about it unless it comes up.Whitch i dout it would because it was so long ago.U should be good,if you been working all these years w no problem and schooling then most likely its not on your record no more or else they would of brought it up.You can call an officer and ask him to check it or just ask him how to find out.he cant arrest so dont be affraid to call. I have cops as friends and they talk to me about alot of stuff,not about me but the guy i was w had a felony and some really bad records on him never knew it but I asked for him.

Maybe not but just incase id ask a police officer or a judge 1st. If the police officer cant help then ask a judge or call DMV and ask them who to call for answers,or call ur unemployment office they can help answer your questions wether they know it or not they will give you a # to call. I dnt know about your state but here in South Carolina in 7-10years it would be spunged off your record. 2 more years and that other one you talking about would of been off your record too if you lived in SC. Like I said i dont know about your state ask one of those ppl or places i mentioned earlier about the laws and if it comes off your records in that state at anytime period. I hope this helps.

O.K. I have a couple of arrests for not paying traffic tickets..I just proscratinated and eventually forgot about them...only to be pulled over yrs later and arrested for having outstanding tickets on two separate occasions thus...two different arrests 18 yrs apart...plus I have one for simple assault (non violent) for touching ex-GFs arm while she called the police and I touched her arm and asked her if she was calling the cops on me...needless to say I was arrested and charged with assault for that...got deffered adjudication..plus a misdemeanor insuficient funds check (less than 200) also deferred adjudication. On my record..I want to apply for a Nevada license..but am worried they'll say no. What do you guys know about the Nevada Board? Are they forgiving? or are they hard core strict?...I already applied and disclosed all of this to them. I know some of my stuff isnt as bad like what others have posted here ..but in reviewing the discipline site. I see that a physician was accused and convicted of transporting and possessing child porn is going to be allowed to reapply for a medical license after a 3 yr license suspension...can you believe that?...

does anyone in this forumn know about felonies in georgia i received conviction 5 years ago for dr shopping going from dr to dr without telling each dr i was getting scripts from the other drs etc and in ga that is a felony. i have an incurable medical disease which has chronic severe pain as one of the symptoms thus got caught in the pain dr cycle and resistent to meds then seeking larger and larger doses....i know on this site people have posted things about states such as virginia SC etcc and how those states felonies drop off after 10 years become sealed and so on. I was hopinng someone could give me advice on where or what to do to check into having my record sealed or expunged in Ga??? thanks

I have a Reckless op on my record, from 2005. It was scaled down from a DUI, (which i could have fought but had no money or help to get a lawyer). Anyway, I applied for my license here for RRT, and I am wondering if im going to have a problem... I didnt have any issues with getting into clinicals or doing clinicals at any hospitals. I also didnt even know its still a misdemeanor. I thought it was just a traffic violation. Either way. I had to get my court doc's. and send them in with a statement. And now waiting to hear something, but I'm nervous. The infraction was in Utah when i was in the military, but I now live in Ohio. Any ideas?

I live in sc and have a misdemenor that is from 04 and is still holding me back I am a cna and in school for medical lab tech. I will graduate in 2 yrs and im worried I wont be able to get a job bc I cant get a cna job because of my record. The school isn't holding me back I can attend school and clinicals. What is this about spunged in 7-10 yrs and how do I do it?

There are soooo many minorities males with felonies from making a mistake when they were young and the system continues to punish them repeatedly and now they're beginning to lock up females at a high rate as well...there's an old saying, when you lock up a man you destroy a family but when you lock up a woman you destroy a nation. WE ALL have to get together and get petitions signed to change things. WE have to wake up and get these politicans to work in favor of saving us too. There are more churches (& liquor stores) in the black community than any thing. ALL churches are 501c3 (tax exempted) these churches, especially in the black community have attorney's, teachers, professors in the congregation that can have programs such as: HVAC, IT, CNA, LPN, RESPIRATORY THERAPY, ELECTRICAN, PHLEBOTOMY etc. for those in need (allowing active tithing church members, at the church 18months or more, to participate first) then having them sign a contract to give back to the 'mission' to provide for others to go through. The church can then buy homes, and after completing a money management class, sell the homes/condos to church members. The church can raise enough money on pastor's day, women's day, men's day....it can be done! WE've been asleep toooo long and according to the statistics, the 65% of black men being locked up is growing and the percentage of women locked up isn't far behind....
Not being able to have criminal records expunged is just another way to perpetuate the cycle of crime and unemployment; collectively it can be changed nation wide and should be.

I got caught caught for petty theft violation (misdeaminor) which the court reduced to infraction since it was my first time. This happened about 6-7 years ago in San Jose, CA - will this create problem to get into RT program or a RT job in future?

It shouldnt be a problem, I think the board is looking for drug convictions, assaults (sex) or physical, stealing from taxpayers etc...stuff like what you were charged with shouldnt keep you from getting licensed...but just be forth coming andndontntry to hide it...They Will Check. Just a simple explanation like the one you wrote here should suffice. They might ask you for court records like proof of fines paid and a letter from a probation officer or community service department if you had to do any of that stuff. Having stuff expunged sometimes wont work when it comes to the board(s) of most states because they ask for expunged convictions too. But having them expunged from public records means you can omit it from job applications. The only way you would have to admit it is under oath and or to state boards if they request it.

Hey Joe, I'm thinking about moving down to the valley...Are respiratory jobs plentiful in the Mcallen/Harlingen area? Also, what kind of pay can be expected?

Bro...jobs are kinda scarce this time of year, but the PRN rates run from about $27 without (differential) to $35 per hr. During the winter agencies such as Millenia & MSN both out of San Antonio supply most of the prn workers. That would be a good time to make the transition agency pay in the valley is $34 an hr. The Valley Baptist hospitals pay the lowest about $23-$24 for RRT most other places pay in the mid 20s. But a lot of RTs around here make $55000-$60000 a yr...just depends if you work prn somewhere else or just put in overtime when its allowed. There are no unions down here except at a couple of HCA hospitals but its only for nursing. The Mcallen, Edingburg area pays the most. Plus we have Lifecare hospitals and Solara LTACs that pay very well from what I hear. Busy winter seasons down here are from late October (when we start getting the first cold fronts) till about Mid March. With agency work you can add a good 12-16k more to the $55-$60 base that I mentioned. Cost of homes down here are very reasonable. 125k to 150k will get you a very nice house. This past yr there was only one hospital that used agency workers this past winter that was Valley Regional Medical Center in Brownsville.

Best advice I can give you, is that you will probably have to reveal that to Boards if you apply in different states..but have it expunged from your record..so that you legally can deny it, including the arrest, will be sealed...boards will have to know, but not employers. The only time you would have to reveal stuff would be under oath or maybe if you're selected for jury duty, when lawyers want to find out the backgrounds of jurors and the judges will ask that you reveal all arrests. I applied in Nevada and had to reveal a couple of run in with the law...but its better to be forthcoming than to be brought before the board for lying then losing a license which will then snow ball when they inform all boards including NBRC if you lose a license in one state other states usually honor the punishments and they will enforce the punishement rendered by the first state that dished out a punishment, and you could potentially lose your ability to make a living. I chose to answer it all truthfully...besides its not like your going to answer the questions face to face. Its all done by mail...Good Luck

Hi everyone, I have a question for you all. I been a RT for 16 years, I hold lic. in six states, I have never had any dis. actions taken out in any state.......AND I HAVE NEVER HAD ANYTHING other than a traffic ticket until recent. I moved to Ohio and was not taken my antidepressant, I have suffered from migraines for 20 years and take Lortab ( a narcotic) for pain. Well I was taking more than I should bc I was depressed and i had "3" scripts open at same time. Well I stopped taking medication May 11 th and sought help and never took any more. Well on June 8th i got indited for a FELONY for "Dr. Shopping". I guess OHIO is cracking down from what I read. Well I had to get a Lawyer and was soooo humiliated and devastated. They (OHIO DA) want me to do a year program with drug court then they will expunge my record and the Felony will never be on there. I WILL DO WHAT EVER I HAVE TO.........BUT I am so affraid of loosing my Ohio RT lic. DOES ANYONE KNOW HOW THAT WORKS ???? I am not up for renewal for 2 years......since I already have my LIC. can I loose it bc not I have a FELONY ??? Can they take it away now ???? Any help would be appreciated,I cant find answer anywhere, not even with OHIO RT board. THANKS !!!!

S.C. in 2009 passed limited legislation allowing some felonies to be expunged after a certain time has lapsed. But this has limited application. For instance, DUI felonies cannot be expunged nor can any felony involving the use of a motor vehicle.

And now waiting to hear something, but I'm nervous. The infraction was in Utah when i was in the military, but I now live in Ohio. Any ideas?

I doubt you ll have a problem...i think they ll definatley ask for records..court, fines imposed, dispositions, proof of completion of any probation..so if i were you i'd go and request this stuff..in Nevada they even asked for arrest reports, if they still exist...dates you went to court, dates of arrest etc..it will take a little time ...but be truthful. I seriously doubt a dui will affect you..unless you were goin to drive an ambulance...anyways i have a coworker that has a dui ..and he s working...but i think he got his dui after he was licensed...

You stated in your comment, "There is a bill that ....keeps getting shot down, the only state you have a shot NOW is IL. The have a waiver that can get you through." An election year is coming up, we can get this changed if we ALL come together. Also can you clarify for me the statement you made regarding receiving a waiver in Illinois for a felony. Does that mean any felony?

True- however, people do make mistakes and addiction is an illness not a crime - I guess we need to make noncompliant diabetes patients, obese patients addicted to food and costing the healthcare system millons and noncompliant heart patients felons as well. If we treated the illness and just didn't throw them into the justice system for the rest of their lives, all of society could benefit.

Would a dismissed paraphenalia charge hold me back from getting a new job. I have been an RRT for 5 years. Now i want a new job. My old roomate and his friends were making noice in out apt. and cops came and dished out tickets to both of us, even though it wasnt mine. He took blame in court, and judge made be do 6months of cautionary probation so they could drug test me, and if i was clean the whole time it would be dismissed. I finished it up without a hitch and it was dismissed and sealed
