I had 5 month layoffs, yet they would call me in for work, but would get test notification instead. As long as I am not working, it should be none of their business.

If that company is on the dac. There is a good chance that the fail is on there also. If it is per DOT you will have to talk with a SAP. Substance abuse professional. Maybe they did not report it, the company you failed with. Read the reason they gave for your seperation. Be careful.

Yeah, you are another one who is clean as a baby, never have done anything illegal, and know everything better than all of us combined. Let me tell you something.....you can snort, shoot, drink...cocaine, heroin, LSD, Meth, alcohol and so on, and that sh** is out of the system in 48 - 72 hours (you heard that right!), but if you smoke weed, which is grown by GOD, is good for your health (supresses asthma attacks, helps with the pain from radiation and chemo, is a natural antioxidant, speeds the healing of wounds...), is non-addictive, is a natural herbal medicine for MANY people, and so on, people are screwed because this is the ONLY HARMLESS drug that will stay in your system for up to 30 days. I think it's about time to start THC drug tests that only show the results for THC for the past 48 to 72 hours. So before all you "I'm so innocent" people open your mouth, maybe you should consider ALL the facts ! What that THC drug test is basically saying is...don't smoke weed because it stays in your body too long, but...you can take heroin, crack, cocaine, LSD, meth...because you only need about 3 days to clean up. That really makes sense...(????). No, it doesn't make sense - this crap is absolutely bull****! What I do in my own home, on my own time, as an adult, should be solely my problem. But hey...drink alcohol, it is so much better for you...yeah right!

SAP= Substance Abuse Professional. This is a professional who has to give you drug counseling if you ever failed a drugtest or got a DUI/DWI. They have to be DOT certified. So if you ever get into this situation, make sure they are DOT certified, otherwise DOT will not accept your treatment!!!!!!

Alcohol is the worst drug there is...I don't see people stop using that. Just because it is legal (alcohol should NOT be legal!!!) doesn't mean it is the better choice. If an adult wants to use drugs, it is his/her choice. As long as they don't use it and/or are still stoned while in the truck or at work, I could care the heck less. I say legalize them all and give tests that determine whether someone just recently (within the past 24 hours) took them or not. Believe me, there are much worse prescription meds out there, than any drug on the market. Next time, try a prescription heart medicine and see what it does to you. But hold on to something because you will be "swept" off your feet.

Not necessarily. I hate it when ppl only see the dark side of the moon. Dude, try it with an O/O and especially one that is older and would appreciate being home more often. You may have to drive for lower pay, but that's still better than no driving job at all. Look around in your neighborhood and see if you cannot find trucks sitting around in the yard. Knock on the doors and talk to the ppl. Be honest and sincere. Maybe drive out to the country side and look for log truck owners. Tell them you are for hire if they need a driver. Give 'em your business card. There are many routes you can take to get back into driving. The smaller trucking outfits are much more willing to hire you (and they are the better companies anyways).

Majority of people I talk to say keep them and keep my medical card current. If anybody can clarify this for me and tell me some trucking companies to apply to email me at ajr3473@yahoo.com

Yes, there are companies that will hire you with this being over 5 years old. Providing that you have been doing something productive with your time during that period.

If you have no way to verify how you spent your time during that period, it will present a challenge for you but you may still be able to find a trucking job.

President Bush did cocaine, but was allowed to ruin this country for eight years. President Clinton smoked pot, but he did not inhale, right. But truck drivers are penalized for the rest of our lives. That is B.S. and we need to do something about this on going B.S. situation. I am sure that most of us are telling the truth about our situations, soe aren't. But we are being treated as liars. You did it so you must do it all the time. That is the way we are being treated. I did it at my class reunion after party, but not since. So am I a pot head? Am I abusing pot? No. No. I will not give D>O>T any more of my money. I say F^^k trucking.
I failed a pre employment drug test in orientation. some companies have approved me and only one has denied me and some kind of way was able to find it.

I smoked pot and failed a random back in 2010. To the person who said, "Why do you pot smokers smoke after choosing this career? Do you think once you pass the test during orientation you're home free and will never get tested again?"

Some people make mistakes. "You Pot smokers" Whatever. I'd still smoke it if it were legal and didn't affect my career. It's fun.

My question is why do some people have to frequent failed drug test forums and be self righteous jerks? Maybe it's "your" high.

I have been working as a CDL driver since May of 2012 and have one more supervised random to go. To correct a few mistakes on this page of the thread.

1. You cannot "sue" a company for them failing to use you while you are in a SAP program. Each company has the right to dictate their own policy on drug use. You could only sue them for discrimination if they allow someone else to complete the program and not you. That is discrimination. If they are zero tolerance, they have that right.

2. Whether it is on your DAC or not, it is still a failed random and you are disqualified to drive UNTIL you successfully complete the return to duty process. Not in 2 years, or 5 years - repeat, UNTIL YOU COMPLETE THE RETURN TO DUTY PROCESS.

If you lie, get a job and kill somebody - you will be at fault if they dig that failed random up.

Once you complete the return to duty process ( and this requires employment and a year of follow up testing ) you do not have to disclose your failed random after the 2 year window is shut. So, let's say you work for an O/O and put in 2 years and want to go to a major company, the failed random does not have to be mentioned as long as it's been over 2 years.

Read the applications carefully.

You obviously enjoy sitting on your high horse while urging people not to get high. Chew on that one for a while.

Please continue on with the obvious advice. Or better yet, why don't you encourage people in a positive way instead of insulting and berating them?

BTW, I've had 7 drug tests in the last 10 months. Didn't get hurt either, it's just what I signed up for.

You need to go through a substance abuse evaluation with a DOT certified SAP. Failed drug tests can show up on backgrounds checks and failure to disclose positive test results are subject to a substantial DOT fine. I am currently working with an individual who didn't disclose a violation and drove and ultimately was discovered and is currently facing a $10,000 fine. Trying to avoid dealing with the issue is a mistake.

So why are you special to get such a card?No carrier will give you a second chance when it comes to drugs.Trucking is a very unforgiving career.I don't know if this will go on your DAC or if you even have one since you wasn't technically employed.Your best bet is in a couple months when its out of your system is pay for a drug test at the doctor. If it comes back clean they start applying.A failed drug test is one of the worst things to have on your record in this career.

First, it'll take you longer than a week to clean out, especially if you were a habitual user. If you had a medicinal marijuana card, you probably smoked pretty regularly.

You are disqualified to drive commercially until you meet the requirements of a substance abuse professional. (SAP) I'm not going to go into detail on how this is done, there is a lot of information on the internet with regard to the process.

You can't smoke weed and operate a CMV with a Class A, and the rules are strict for a reason. I'd suggest seeing if you can get your old job back for a couple of years and bide some time. I'd also go to USIS and pull your own DAC report and see what comes through the system. If it's on your DAC, you won't drive for anyone indefinitely until you complete the process.

Bad move for an entry level driver. You don't have a lot of experience to bring to the table, and most mega-carriers will wash their hands of it. Good luck.

I have not been in a CMV since 2000. I recently applied at a company. My drug test came back diluted and negative. They let me take it again. Now here is the kicker. (I tested myself twice over two weeks and both were negative prior to the company drug test. I thought everything was going to be ok but then over a week later I get a call from the MRO asking what meds I was taking. He said yes they would make me test pos for pot. I have not heard a word from the company since. I spoke with the fed DOT man in DC and he said to continue with a trucking career I had to go see a SAP. What I would like to know is how long does it take the company to report it to the state that issued my CDL ? I applied to a job out of state. The MRO said he was not required to report it to the state I live in. I am wondering if the company will? Any answers on this? Im pretty sure Im going to throw in the towel and just let my CDL go back to a regular DL. I have paid to keep it for 14 yrs with out needing it anyway.

I have no family(wife or children)and able to relocate or do whatever it takes to get back in the truck driving industry. I've been out of work for 6+months and I am between a rock and a hard place. If you believe your company is willing to give me a second chance and hire me, I would be very grateful to you and company. If you are able to give me some input, my email is sharpedges59@gmail.com Thank you much!

Not true. Over the course of 16yrs i have failed 2 pre-employment tests and 4 randoms. There are ways to get around the system. Big thing is to have no points and no accidents. Ive always gotten a job, a really good job. Currently as a local driver i work 50hrs a week, gross just over 1200/ week and have outstanding medical and retirement benefits. Paid personal and sick days, etc.

How did you get around it? I have one positive just in august 2014 did the sap. But I did the sap before the date of cdl suspension so my cdl was not suspended.

Mary English in Birmingham, Alabama said: I am currently looking for a job in trucking. Back in 2005 I was smoking Mary Jane and came up dirty with swift and my brother refused to test on a pre employment test for swift. I completed the SAP program and went to get help with my problem with weed. I've been clean now for 4 years. My question is can I get a second chance at driving with a failed drug test or refusal on DAC report after 5 years or should I just turn in my cdl 's and get regular class c licenses to drive my car and go on to another career. Majority of people I talk to say keep them and keep my medical card current. But when I go to fill out an online application those questions are there about have you ever failed or refused a drug test and it does not specify the time frame. If anybody can clarify this for me and tell me some trucking companies to apply to email me at ajr3473@yahoo.com

I work in HR and we have hired people who have been to jail for drugs but are clean now. I would say if you are honest up front you should be able to find a job, the employer that will listen and give you a chance will be a good employer, the others would not be, hope this helps, don't give up we all have a past.
