jamesneworleans in New Orleans, Louisiana said: 1966 got felony ,car theft,in Virginia. gov recently gave full restoration of all rights except firearms. Virginia says to get it from state of residence. State of residence is Louisiana . They say to get it from Virginia. Also the Feds have their own law on the books. Previously ATF handled the deal. Now ATF won,t do it. Anyone know any way legally around it. I live and work in high crime city and need to be on the job immediately after hurricanes such as Katrina.

Sorry, but the ATF will never allow it. In Texas and Tennessee you can carry muzzleloaders (also available in pistol form) because in these states they are not considered "firearms", but rather, "primitive weapons". The down-side is if used for self defense, better make that one shot count. Hope it helped. Unfortunately the right to bear arms no longer applies.

It depends on how serious the felony....Class A or B felony-(5 years)or class C, D or E felony (time= 3 years)..... there is a certificate of good conduct or clemency that would be needed to get done through(God) and your own energy ( at no cost) or through a professional lawyer(with God through HIM)>>>>> at a reasonable fee....after five years in some states and after 7 in some states.
All documents (depends on situation) will be filed with the appropriate administrative or judicial authority. Every situation is different and a personal matter.
Through the state bar association you will be able to get legal advice for a lower price opposed to paying a big fee to a top notch lawyer.

You are beyond expungement once the felony is committed.
The process will be pardon, sealment of crime or other forms of relief.contact your states clerk of court.

What is the proceedure for class-A & class-C misdemeanors (Assault charges) in the state of Texas? Although my charges are not felonies, the positions I apply for deal directly with the public; therefore, I am denied employment or let go after a background check is conducted. I need to have my record(s) sealed or expunged. Do you have any advise for me in these matters. Willing to do the leg work myself...just need a platform to start from.

if not felonies you can always go directly to a lawyer and have it expunged...may be a bit costly but it is the quickest. Call your courts to find out what to do if have time to go through a somewhat challenging process (for free)

Hopeful Person in Dallas, Texas

Hello. I hope someone can help me. I am interested in applying at Baylor Health. I have a DUI (misdemeanor/nolo) and theft (dismissed but not expunged yet)

They are two years old. Does anyone know if this will rule me out?

Also if I am successful, I will make sure to post tips and info because I know someone in HR. I don't want to ask this person until after the fact. (Personal reasons.)

If I can get in the door I will find out any and all info and post it here.

Second. What is the best service to use to run a background check on yourself? I would like to know exactly what an employer sees.

Thanks.

Hope

For all those looking for employment & a place to live: You will need to apply at smaller, mom & pop type establishments. Right now, it is am employers market & it is difficult for anyone to find a good job much less if they have a record. Do not give up. There are places out there. Many Plumbing/HVAC companies will hire you (depending on the type of conviction although I do believe that any assault charges may hold you back because you will be going into customers homes), Truck Driving and Landscape are other options. Hey they may not be glamorous jobs but they do pay the bills and you can be proud to have a legit job. Now for housing. You can definitely go through the Rent-To-Own classifieds (especially Craig's List). Many of those do not even run background or credit checks. Again, this is because of the economy right now. Owners need to get payments on those empty properties and will allow just about anyone in there.
I know it may see tough right now, but believe me, there is hope. I too am an ex offender. I was laid off a few months ago & was really down. Went on an interview 4 days ago thinking I would not hear anything back at least until Friday. But then something spectacular happened. I got a call the very same day & started working the next morning. The company is fantastic & everyone has welcomed me with open minds & hearts. So you see there is hope.

thanks for the reply.
I'm not concerned about your past (I don't mean that negatively), just now and your future.
I know it's a vicious circle, because you can't get a job, so you can't get good credit, so you can't do anything...
So lets see if we can make some money,ok?
I'm not sure if this is for you, and please don't get scared off.
I provide Fire Service Consulting for financially strapped Fire Protection Districts.
They are not city Fire Departments, but are Fire Protection Districts covering rural areas and communities. generally they cannot afford to send Firefighters across the state to Fire colleges and Training Centers. So we bring training to them.
Now, thats the first part, the real goal is to have these ff's go back to their fire districts, and inform their trustees and board members that there is help for merger prevention, reorganization, and resources. That what we do!
Ok, you;re still saying what about me right?
This is where I may lose you, hope not though.
1. You greet the attendees, give each ff a packet of materials.
2. When either I or any guest speakers are speaking, you would be "Eye Candy" (Remember, most of these ff's are volunteers and guys, who want to enjoy the program and have a good time on their day off.
3. You operate a VCR (Usually only 2 fire videos).
4. Host a raffle/door prizes, giveaways.
5. Need you to have my back, always referring the ff's to me, explaining that "We" can provide the solutions to their financial and organizational difficulties.
6. You would be an attention getter. I don't need a model, but I need you to do two things, so here goes.

Wrong!
You are the one needing employment, unemployed, and prctically unemployable or you wouldn't be on here!!
Because you don't understand marketing, you classify it "soft porn" Really?
Its understandible why you are in that situation.
Don't blast somebody because of your failings!
As an independeant contractor a job description like you stated is spelling it out, no hidden anything, no farse, just upfront requirements and prefrences.
You need to step back and read, instead of ranting!
This small company works with many ex felons and provides employment when most won't!
A Minister from a ex felon program sends many ex felons to them.
Stop trying to get attention by speaking out without having insight!
Maybe then you can get a job instead of being on a forum!

Dee, I wanted to say that most convictions can't be expunged in the state of texas. From what I know you had to have had it dismissed, found not guilty or acquitted(I am almost 99% percent sure on that). If you've had it dismissed or found not guilty then you can normally get a expunction but you have to wait for the statute of limitations to run out. I think in some cases if you are found not guilty then you can get it expunged right away. I think for class c misdemeanors who received deferred adjudication can also get expunged.

I do know that sealing (non-disclosure) works differently. You do that if you have had deferred adjudication. I know that there are some offenses that cannot be sealed... (murder, rape, sex offenses, domestic violence).

I may be wrong on this stuff so please don't hold me to my word on this.

As of lately I been think about either moving to another state that I can find a job in my field which is socail work or to another country. I know there are other people out there with my same problem, but is there someone other that can help me with this. I don't want a handout, I work for everything I done to make myself a better person. All I need is help getting where I want to be and that is running a center for felony that help then be better people when they get home from prison.

In addition to that I even bought the Certificate from the State of Texas and they still did not hirer me. I applied at children Medical had an interview and everything and they still did not hire me. With an expunge you thinking everything is ok but it is not. I will not give up that is what the devil want. He wants to siff you so he may have you and your mind. God is in control of our lives. So since we do not have jobs focus on helping other people to succeed or comfort. Take your mind off of yourself and stop worrying! Man say No!!! but God say Yes!!!!!! God is our provider, and he will provide for us if we focus on his love and the word. God forgives man but the world does not. God will supply all your needs and more just be patient!!!!!! and pray read the word of God and he will answer if you are sincere. Change the way you live and watch his blessing over flow you with goodness. Look at TD Jakes eg. A man of God with prosperty all over the world the reason, He put God first not last. Look at the bible movies of Jesus, he suffered that we might live. He wants us to prosper but we must seek him FIRST. LOVE YA'LL DONT GIVE UP PRAY. I am talking about the expunge.

I am happy to say that I worked for this organization for over 2 years, and you don't have any sense of marketing!
You are obviously lacking education!
You are a bitter person along with being an unemployed felon!! In your case, you are what you are and it shows!
Sexy women, sexy smoking, is all about drawing attention. You don't have to like it, but to openly criticize somebody that you don't know is pitiful!
You don't have to agree with a companies philosophy, but you don't have to be ignorant!
You need to apologize for your rude remarks!!

I am not at all bitter about anything and I am not an felon. I do apologize if you misunderstood what I was saying. I am not against any company in this world, I simple want a chance to prove that I am capable of achieving. Right now I am not going to rebuttle to much because my mother has cancer and she does not have long. However, I do have lot of education more than you would know so please do not try to put a person down saying lack of education. I have many fields of education and I will planned to continue even more once I get over my mom. You do not have the right to put a person down. Do you know God? I do maybe you need to get the word and read it for educational. I bet you, I can qoute scriptures you never even heard of.

Peace and be Bless

PS. I am very happy youv'e been on your job (2) years. I wish you more success mine will come soon I just have to wait on God.

Hello, I have read a couple of post here. And I am hoping to find some assistance for my husband. We recently relocated to the area without the knowledge of the type of backgrounds they do here. We came from a very racist town out of North Carolina where I, a college educated woman could not get work due to my color, and I was told this. While we were in this town, we got pulled over 17 times with no tickets or arrest. Unfortatuly, my husband was with the wrong people and got in some trouble. He got charged with a felony, but took a plea as a misd. In other states, including NC they do not look at your arrest record, which I think should be every state to to the police being human and they to do bad things and make many mistakes, so he never had a problem finding a job. Then we moved to Texas where we thought I could find one and he was going to work on Jets, the job was already lined up and to make a long story short, no luck any where for him due to this stupid place we lived in for only 1 1/2 years. Now I have a job, and he is not able to find one. He has references here from business owners in the city of fort worth and has a excellent work background. He is a quick learner and he is a hard and dedicated employee. I mean everyone tells him and I this all the time. Would anyone know where he could get a job? We have three kids and he has to find work that will at least pay for daycare and then some. You can email me at danyelle202@aol.com with any leads, we really appreicate your help with this situation. We can't afford to move again.

hello, i just found this site, i am looking for a job for myself and husband, as for myself, i am a certified medical assistant, i graduated in sept 08 and still havent found a job, i have been to several interviews but no luck, i have a misdeamoner terristic threat from 2005 it sounds ALOT worse than what the curcumstances were. My sister-n-law claimed i threatned to beat her up after i caught her stealing from me. She has a record for things like idenity theft, fruad, bad checks, ect.I stupidly plead guilty when i went to court because I just wanted to get it over with,my husband who she also accused went to court and he plead not guilty and it was dropped. that is all i have on my record, people think i tried to bomb something, when i tell them what the charge was. I did really good in school for medical assistanti was a student ambassador, my GPA was 3.7 and i got an award for my attendance. I really hate to think i went to school for nothing.
My husband needs a job really bad too, he has 2 felonies for drugs but they were from when he was 17 he is 33 now.He has also had his lincense taken away for getting behind on child support,he has experience in construction and he is a very good mechanic, but he has no tools, he has worked at lawnmower repair shops before and did excellent work, he was also a machine operator, he can drive a fork lift and was certified for that
so if anyone can help that would be great

Now I am trying to see what else can I do. It is like, I went to school for nothing. My family was so proud of me because I even took the Certification test and past but no one wants to hirer me because of my background. Remember even with a expungement the agencies can still provoke you from growing, because they still have access to your criminal record. I have lost hope!!!! Now I am seeking warehouse jobs and still no luck. I do not recieve unemployment and my utilities may be cut off. But I will not give up on God because he can change everything I just gotta keep trying and praying. This will be my last comments as tears role from my face.

i wanted to let u know i totally understand how u feel, i also went to school for medical assistant and did great my family was so proud and suprised that i finally was doing something with my life , i graduated in sept 08 and still dont have a job in that. i know how bad it feels to start looking for jobs that u were trying to get away from, i have also started looking for cashier jobs and other jobs. The school loans bills keep coming in adn i feel like i went to school for nothing but to pay for the loans. So u are not alone , good luck

Have you thought about going into business for your self..I know you mentioned your were a stylist--was that so bad. Continue on with that gift. Or go back to school and call your probation officer-there should be someone in that office that will be able to assist you in finding a job. Your crime is relevantly new---cant have it sealed until the 7th year. I wish you the best. This part of your life is called being very creative as well as "waiting" and being patient. Also try networking...to find a job you may like. Best wishes

Keep trying, We as ex offenders need to stand up for are rights. I am having the same problems with finding a JOB. This country is not forgiving at all. No matter how much education you receive, its still hard to found a job. Thats way I truly believe that we need to go to CONGRESS.No
