Job Description VMware has a newly created position for a Senior Director and Counsel, Litigation. This person will be based in Palo Alto, California and will report into the Vice President, Deputy General Counsel, Litigation and Compliance. The primary job responsibility is to manage litigation and pre-litigation matters at VMware. In addition, as a member of the Litigation and Compliance Legal Group, this person will have the opportunity to be involved in strategic legal projects.

Role description:
This position will involve working with business unit managers as well as the broader VMware legal team. Specific duties include the following:

  • Provide practical, business-savvy pre-litigation counseling and litigation representation to our global VMware business units in all areas of complex litigation, including commercial, patent, trade secret, and employment litigation.
  • Partner with business legal teams outside of the US as necessary in litigation, counseling and compliance.

  • Aggressively manage and reduce outside counsel spend on all litigation matters.
  • Provide legal leadership for e-discovery practices.
  • Proactively inform business leaders about litigation-related updates and/or trends, and develop strategies to address commercial, patent, trade secret, and employment litigation issues.
  • Act as a thought leader on litigation issues and influence a broad cross-section of the organization.

Competencies:
1. JD from a top-tier law school and 15 or more years of experience, including at least 5 years in-house managing a broad range of pre-litigation counseling and complex litigation, including complex commercial, patent, trade secret and employment litigation, in U.S. state and federal courts; experience managing litigation in non-US forums a plus.
2. Admission to CA state bar required.
3. Significant experience with a broad range of complex litigation in US state and federal court, including complex commercial, patent, trade secret, and employment litigation.
4. First chair jury trial, bench trial and/or arbitration experience required. Experience handling all aspects of discovery (especially e-discovery), arguing dispositive motions, and developing case strategy from complaint to verdict/settlement and/or appeal.
5. Excellent interpersonal skills and the ability to work collaboratively as a member of a team and/or a leader of a team across regions, business units and functions, including the ability to be diplomatic and culturally sensitive, but also firm and clear, as necessary.
6. Experience aggressively managing outside counsel strategy and litigation budgets.
7. Demonstrated success in advising and supporting senior executives.
8. Excellent analytical, communication, and time management skills.
9. Strong enthusiasm for the job, a hands-on mentality and a commitment to help VMware’s Legal Department deliver best-in-class legal services
