This position is located in the Legal Division, New York Regional Office. The incumbent serves as Regional Counsel, Open Bank Regional Affairs Section ("OBRAS"), at the Corporate Manager level, and is responsible for legal services pertaining to the examination and supervision of all insured banks under FDIC’s jurisdiction in the New York Region. The incumbent reports to the Deputy General Counsel, Supervision Branch, through the Assistant General Counsel (AGC), OBRAS, or designee, for the legal work performed in the Region in support of the Division of Risk Management Supervision. The incumbent reports to the Deputy General Counsel, Corporate, Consumer, Insurance, and Legislative Branch, through the AGC, Consumer Section, or designee, for the legal work performed in the Region in support of the Division of Depositor and Consumer Protection. The incumbent reports to the AGC, OBRAS, for administrative issues.

DUTIES:
  • Manages and supervises the activities of a staff of attorneys, paralegals and administrative/clerical support personnel, providing any necessary instruction, review and counseling for their training and career development, including the preparation and/or review of their performance evaluations.
  • Manages, performs and supervises all legal services pertaining to the examination and supervision of all insured State nonmember banks located in the Region and is responsible for the management and direction of all substantive and administrative matters arising from such legal services conducted in support of the Division of Risk Management Supervision and the Division of Depositor and Consumer Protection.
  • Conducts and supervises the conduct of administrative and investigatory proceedings under sections 7, 8, 10(c), 18, 19, 29, 30, 32 and 38 of the Federal Deposit Insurance Act as well as other banking laws and regulations including ILSA, Regulation O, consumer laws and regulations and "prompt corrective action" matters. Also handles or supervises litigation of these matters in state and federal court, as appropriate.
  • Participates in and supervises negotiations and consummation of settlements in cases concerning the Corporation's supervisory functions arising in the Region.
QUALIFICATIONS REQUIRED:
Candidates must have at least one year of specialized experience as an attorney at a level equivalent to the GS/CG-14 drafting pleadings, briefs, motions, guidelines, memoranda and other legal documents incident to the prosecution of enforcement actions; conducting hearings before administrative law judges; conducting investigations; performing legal research; negotiating legal positions; orally presenting analyses, conclusions and recommendations concerning federal banking law or consumer protection and compliance laws applicable to insured financial institutions. Such laws would include the Federal Deposit Insurance Act, or a comparable federal financial regulatory scheme.

There is no substitution of education for the experience for this position.

A. Ability to manage and administer the legal work in the Region.

B. Knowledge of all facets of administrative litigation.

C. Ability to litigate, supervise or coordinate litigation as it relates to the resolution of enforcement matters brought under the Federal Deposit Insurance Act and other appropriate laws.

D. Knowledge of administrative law, consumer protection laws, commercial law, and Federal and State banking laws, including the National Bank Act and the Federal Reserve Act.

E. Knowledge of the procedural and substantive aspects of the requirements of discovery, trial preparation, trial strategy and argument.

F. Knowledge of Federal and State bank examination proceedings, banking practices and procedures, and Corporation policy.
