You will serve as the deputy legal advisor to the U.S. Army Criminal Investigation Command (USACIDC) Computer Crime Investigative Unit (CCIU). As a CCIU legal advisor, you will develop policy for the USACIDC as the agency implementing the DA computer crime investigation effort. Provide legal advice to CCIU managers and all CID special agents in their worldwide computer crime investigations, to include drafting and reviewing affidavits in support of search warrants involving digital and other kinds of evidence. Serve as a senior advisor to other Army civilian attorneys and judge advocates regarding investigations involving computer crimes. The incumbent's legal advice serves to ensure that the investigations provide a legally sound basis for criminal prosecution in an area of complex, intertwined federal laws. The incumbent deals directly with Army and Department of Defense (DOD) officials, officials from other federal agencies, to include those concerned with law enforcement and intelligence, and works closely with Assistant United States Attorneys in most judicial districts of the United States. Legal work in this specialized legal field requires current knowledge of numerous interrelated Federal and state statutes and regulations, judicial and administrative decisions, executive administrative orders and directives, and expertise in criminal law, intelligence law, classified security procedures, national security law, federal rules of evidence and rules of criminal procedure, UCMJ and Manual for Courts-Martial procedures and a specialized knowledge of computer technology.
Applicants will be evaluated to determine if they meet the minimum qualification requirements and on the extent to which their application shows possession of the following knowledge, skills and abilities (KSAs) associated with the position. KSAs:
1. Knowledge of Federal and state statutes and regulations, judicial and administrative decisions, Executive Orders and directives and specialized computer crime expertise in criminal law, intelligence law, national security law, international law and a working knowledge of computer technology and networks.
2. Knowledge of Federal criminal investigative procedures such as Federal search and seizure law; military search authorization law and procedures; procedures for collecting, safeguarding, and presenting evidence at trial.
3. Knowledge of and experience with Federal practice, such as drafting legal process, working with Federal rules of evidence and rules of criminal procedure, UCMJ and Manual for Courts-Martial procedures, classified security procedures, procedures for the preservation and obtaining of evidence in foreign countries, and Privacy Act requirements for sharing of information.
4. Ability to analyze and guide criminal investigations involving all aspects of computer crime, including intrusions by unauthorized individuals, child pornography and national security cases.
5. Ability to communicate orally.
6. Ability to communicate in writing.
VETERANS PREFERENCE INFORMATION: There is no formal rating system for applying veteran's preference to attorney appointments in the excepted service; however, the Department of the Army considers veteran's preference eligibility a positive factor for attorney hiring. Time in Grade Requirements: If currently employed as an attorney by the Federal Government must have completed 1 year at the next lower level within 30 days of closing date of the announcement, or previously served at the same or higher grade as the position being filled.
The following minimum qualification requirements must be met before applicants are eligible for further consideration.
Education: An applicant must have successfully completed a full course of study in a school of law accredited by the American Bar Association (ABA) and have the first professional law degree (LLB or JD).
Bar membership: Applicant must currently be a member in good standing of the bar of a state, territory of the United States, District of Columbia, or Commonwealth of Puerto Rico.
Experience: Applicant must have two or more years of professional legal experience, acquired after being admitted to the bar, commensurate with the duties and responsibilities of the position. Graduation from an ABA-Accredited Law School in the top 25% of the class or an advanced law degree such as an LLM may substitute for one year of the required professional legal experience.
