Staff Attorney
PHH Arval - Mount Laurel, NJ
JOB FUNCTIONS :
Partner with Vendor Management, Servicing and outside vendor to perform risk assessment, review, oversight and monitoring of law firms and trustees that provide foreclosure, bankruptcy, eviction and other loss mitigation and default services for PHH Mortgage Corporation in all jurisdictions, including:

Assisting in the development and updating of policies and procedures for appropriate oversight, review and monitoring to ensure compliance with all applicable state and federal laws impacting the mortgage servicing business as well as supervisory guidance and Company’s subservicing policies and procedures
Assisting in the scheduling of on-site reviews of third party firms
Developing appropriate scorecards and criteria from a legal perspective for on-site reviews
Reviewing on-site review findings and assess third party firm compliance with applicable state and federal laws, rules and regulations and judicial requirements
Guiding Servicing and Vendor Management on continued use of third party firms

Assessing third party firm performance against defined service levels and contract terms and updating service levels as appropriate
Monitoring and notifying management of adverse litigation and media concerning third party firms
Working with Vendor Management and Servicing on the signing, renewal and termination of third party firms
Assisting with customer complaints related to third party law firms
Providing appropriate corporate reporting information

Noting and reporting trends and risks on use of third party firms to senior management
Serving as resource to Vendor Management and Servicing for legal and oversight issues related to use of third party firms
Provide additional analysis and advice as needed

QUALIFICATIONS :
The appropriate candidate must:
  • be a graduate of an ABA accredited law school
  • be admitted to practice and in good standing in at least one state, eligible for New Jersey in-house counsel registration if and as required
  • have 3-5 years legal experience with a law firm or corporate law department, with foreclosure, bankruptcy, real estate, and mortgage banking experience
  • be well organized and able to simultaneously prioritize, handle and track multiple priorities and projects
  • have demonstrated effective written and oral communication skills
  • have computer skills, including Microsoft Office, Outlook, and Access Database
  • be capable of working both as part of a team and independently, as needed
