  • The position supports and advances the business and compliance goals of VMware by preventing, detecting and responding to allegations of fraud or misconduct where the violation may expose the company to criminal or civil liability by conducting investigations using legal, forensic and audit techniques.
  • Investigations may include: FCPA violations, conflicts of interest, financial misconduct, bribery, export compliance as well as supporting litigation matters
Responsibilities: Conduct compliance investigations to detect violations of laws, regulations or company policies, to ensure remediation of shortcomings in accordance with the following procedural steps:
  • Allegation review: investigation scope, planning and initial research of available data, including understanding legal considerations (internal/external), to determine overall investigation objectives
  • Conduct field investigation to establish the facts by:
o Conducting interviews of internal witnesses and subjects
o Forensics Evidence compilation: thorough review and analysis of electronically stored data including system and business records
o Research company procedures and policies related to allegation
o Perform external research as needed (eg. Public records, social media etc)
  • Present findings for further action including the preparation of reports identifying investigation steps with proposed recommendations, including remediation steps
  • Train on investigation protocol: Increase knowledge and awareness of investigative techniques by providing in-person and/or web-based-training to enable subject matter experts enlisted across the company to perform investigations more effectively
  • Maintain confidential files on all investigations under the provisions of the document retention policy
  • Remain keenly aware of data protection and privacy concerns while conducting investigations and compiling evidence files and reports
  • Bachelor’s degree required; Masters a plus
  • Certified Fraud Examiner or Certified Public Accounting qualifications a plus
  • Knowledge of legislation concerning anti-corruption/bribery (e.g. FCPA), antitrust, insider trading, whistleblower protection and retaliation
  • Ability to analyze company accounting records and financial statements and understand complex business transactions; Understanding of corporate enterprise systems (eg Oracle, Workday, SFDC)
  • Skilled forensic interviewer with highly developed patience and listening skills
  • Certified Forensic Computer Examiner or EnCase Forensics training/capability a plus
  • Persistence and the will to ask tough questions and deal with difficult, high stress situations
  • Independence, Integrity, Objectivity and Confidentiality
  • Excellent interpersonal, verbal and written communication skills
  • Advanced knowledge of Microsoft Office (Word, Excel and PowerPoint)
