This individual will serve as Express Scripts lead Labor & Employment Attorney, advising and partnering with key business leaders, and other members of the legal team, in order to provide legal advice and strategic guidance with respect to labor and employment matters including collective bargaining, labor relations as well as traditional employment law issues. The lead Labor & Employment Attorney will oversee and manage a team of attorneys and legal staff, and, along with such team will have day-to-day responsibility for providing practical advice and counseling to the Company on labor and employment issues including: collective bargaining and NLRB, WARN, hiring, performance management and discharge, wage and hour, discrimination, disability accommodation, wrongful termination, employee privacy, non-compete agreements, support for business transactions and other relevant matters. Responsibilities also include management of labor and employment litigation, investigations and administrative charges, as well as review and development of employment and labor policies and procedures, and client training on pertinent issues.
This position provides legal advice and support to company leadership and other clients as a legal expert in the labor and employment law area.
1.Provides legal advice and strategic guidance on labor relations, collective bargaining and related matters
2.Assists with Litigation Management and Risk Management by ensuring compliance with applicable laws, regulations, and policies specifically around labor and employment
3.Identifies and assesses legal risks and opportunities within the labor and employment area or advises more senior counsel accordingly.
4.Participates in and influences the decision-making process with appropriate Senior Human Resources leadership team and Senior Legal Team
5.Assists with counseling human resources on various Labor and Employment legal issues
6.Manages and oversees internal labor and employment legal team and external legal counsel
-Law degree from an accredited school of law and a membership in good standing in at least one state bar.
-Ten plus years of experience in handling labor and employment
-experience with federal and state employment statutes, prior litigation experience, and experience and knowledge in traditional labor and employment law matters.
-Incumbent should have a minimum of three years experience in managing attorneys.
-Must possess a working knowledge of Microsoft Suite including Word, Excel, PowerPoint, and Access
-Candidate must have a proven, successful track record of collective bargaining units and labor laws; including contract negotiations, representing the corporation in complex grievance and arbitration proceedings as well as matters before the NLRB
-Demonstrated strong interpersonal skills by communicating effectively, both verbally and in writing to counsel clients on labor and employment matters
-Experience with, and knowledge of, ERISA and to Federal Contractors, is preferred
-Law firm experience required; preference for in-house experience
-Possess analytical skills necessary for competent legal interpretation
-Must produce a top quality work product, have good attention to detail, the ability to work efficiently, prioritize workflow, meet demanding deadlines and manage multiple projects
-Must possess integrity, initiative and the creativity to provide effective solutions
-Must be capable of leadership and teamwork
