Federal law states that companies are not required to provide paid time off but can do so if they want to. California law states that in the event that a company does indeed offer paid time off, they must pay out any accrued and unused PTO, and any "use it or lose it" policies are actually illegal. So I guess it depends on your state. I know this is an old thread but it might be helpful to someone.
