SUMMARY: Yocha Dehe Wintun Nation (Yocha Dehe or Tribe) is a federally recognized tribal government. The Tribe’s mission is to provide for the health and welfare of its people, to govern its own lands and affairs with sovereign independence and in a manner consistent with its cultural values, and to enhance and diversify its economy for the overall good of the nation. Yocha Dehe’s governing body, its elected Tribal Council, is charged with implementing this mission. As a federally-recognized tribe, Yocha Dehe exercises a government-to-government relationship with the United States, as well as with the State of California and local governments, and the Tribe actively engages with outside agencies and officials, local stakeholders and members of the public.

POSITION SUMMARY: The Contracts Administrator is responsible for the preparation of contracts using templates previously approved by the Tribe’s legal counsel. The Contracts Administrator will monitor contracts primarily for the Development Department and other departments or Tribal entities as required and will ensure actions are within approved policies and procedures. The Contracts Administrator will manage a database of contracts approved and those in process, and will ensure payments are within Finance Department funding procedures. This position will work closely with the Tribe’s legal counsel.

ESSENTIAL DUTIES AND RESPONSIBILITIES:

To perform this job successfully, an individual must be able to perform each essential duty satisfactorily with or without reasonable accommodations.

· Prepares contracts using templates prepared by legal counsel.

· Drafts contracts using terms and conditions from similar agreements (as a starting point for department staff and legal counsel).

· Reviews scopes of work, payment plans, and other specifications to ensure contracts are complete.

· Is familiar has working knowledge/experience with construction practices and terminology

· Is familiar with the Tribes Contracts Policy “Authority to Negotiate, Approve, Execute and Pay Funds Under Contracts” and ensures compliance.

· Ensures that all contracts are reviewed by legal counsel prior to issuing to contractors/vendors/consultants and approval or ratification under delegated authority by the Tribal Council.

· Ensures actions are within delegated authorities of staff, committees, and boards; confirms an approved budget is in place, prior to execution of documents.

· Ensures contracts come before the appropriate Tribal Boards, Commissions and Tribal Council for approval or ratification.

· Prepares resolutions identifying the need for the contract, basic terms, documenting review by legal counsel, and other actions taken are within delegated authority levels for Tribal Council adoption.

· Recommends vendors best engaged through multi-year master agreements.

· Develops monitoring process and ensures department heads are notified at least eight weeks prior to any contract or insurance requirement termination date; ascertain interest in renewal.

· Develops and maintains document list to track document preparation and progression through the Tribes procedures.

· Develops and prepares regular reports on the status of contracts and tracking progression through the Tribe’s required procedures.

· Maintains detailed and organized electronic and hard copy files.

· Works closely with department directors and others to ensure understanding of, and compliance with, contract terms and conditions.

· Acts as a resource to staff regarding funds availability, budget codes, etc.

· Liaises with the Tribal Administration Department, as necessary, for the processing of contracts and documents through Tribal Council.

· Performs other duties as assigned.

Qualifications

The requirements listed below are representative of the knowledge, skill and/or ability required.

Education and Experience

Associate's degree (A. A.) or equivalent from two-year college or technical school; five years related experience or equivalent combination of education and experience.

Experience and knowledge of terms and conditions utilized in various types of contracts used for Construction, i.e., agreements for services, independent contractor and consulting agreements, change orders, work orders, master contracts, etc. Knowledge of legal terms and components required for complete contracts. Knowledge of accounting principles; experience in monitoring accounting for, and payment of, contract expenses.

Communication and Comprehension Skills

Ability to read, analyzes, and interpret general business periodicals, professional journals, technical procedures, or governmental regulations. Ability to write reports, business correspondence, and procedure manuals. Ability to effectively present information and respond to questions from groups of managers, clients, customers, and the general public. Excellent English, grammar and spelling skills, required.

Mathematical Skills

Ability to work with mathematical concepts such as probability and statistical inference, and fundamentals of geometry and trigonometry. Ability to apply concepts such as fractions, percentages, ratios, and proportions to practical situations.

Reasoning Ability

Ability to solve practical problems and deal with a variety of concrete variables in situations where only limited standardization exists. Ability to interpret a variety of instructions furnished in written, oral, diagram, or schedule form.

Computer Skills

Must be computer literate and proficient in multiple functions within Microsoft Office’s word processing, spreadsheets, and database applications. Proficient in Adobe PDF full version, preferred.

Certificates, Licenses, Registrations

Individuals must be able to successfully pass the Tribal Gaming Agency (TGA) Background Check. Must possess a valid driver’s license, and maintain a driving record that is satisfactory to the Tribe’s insurance carrier.

Must have the ability to travel up to 5% of the time. Must be able to work with diverse population and with cultural sensitivity. Must be willing to sign the Tribe’s Non-Disclosure, Non-Disparagement and Confidentiality Agreement.
